Divorced N.J. parents ordered to pay for estranged daughter's college tuition ($16K per year)

CAMDEN COUNTY — The divorced parents of a 21-year-old woman have been ordered to contribute $16,000 a year toward their estranged daughter's college tuition, according to a report on 6ABC.com.

Neither Michael Ricci nor Maura McGarvey have seen their daughter Caitlyn Ricci in two years except in court, the report said. Caitlyn Ricci moved out of her mother's house and in with her paternal grandparents.

Caitlyn Ricci sued her parents in the spring just as they were preparing to ask a judge to declare her emancipated from them, the report said. Her grandparents are paying for her lawyer's fees.

A judge cited Newburgh v. Arrigo, 88 N.J. 529 (1982). In that landmark case, the state Supreme Court ruled divorced parents are responsible for providing for their child's college education.

Caitlyn Ricci's parents told the television station they are appealing the ruling and won't foot the bill for out-of-state tuition at Temple University.

Alot of precedence would be set here.

Could the court means test parents (divorced or otherwise) and force college payments on behalf of children? It’s their money. Perhaps parents they have long term goals. Perhaps parents think the child is not likely to benefit (cost vs. income).

You used to be able to decide how your money is spent.

I doubt this will stand in higher courts.

On the plus side it’s possible that nothing can reunite an estranged couple faster than getting screwed over by a daughter neither can apparently stand.

Actually you underestimate the evilness because you said government interjected itself into Divorce. But this is nothing about the divorce and more about the state law in NJ setting emancipation at 21. Then on top of this ridiculous law the NJSC said this included tuition. I am one of those parents that make their kids pay for tuition (I admit a gave in and pay board). In NJ, my child could sue me for taking this position and win.

The parents failed in their most important duty - raising their child properly. She is a complete and total loss (only a total loss would sue her own parents). They should look at this $16k a year as the fine for being too liberal, too self-absorbed, or too disinterested to raise their daughter properly. I cannot imagine any of my children doing something so parasitic, and I would be disgusted if they dated this type of woman for even one date.

A lawsuit inside the family is unforgivable, and I would permanently sever all ties in response. No wedding, no support starting out in her career, and no inheritance. It takes a lot to break a family, but this entitled little girl has crossed the line. It’s sad to say goodbye to a child, but she is no longer their child. It takes a village to raise a child this spoiled, and Hillary’s village owns this brat.

Yes, I assumed that parents not divorced would not be impacted by this. If they are, then the real life consequence of this is that a fully intact family’s parents can be forced to send their kids to whatever college the state determines they can afford, regardless of the parent’s wishes or understanding of their child as a viable student.

This is orwellian.

There is no way I’d raise a family in that state. No way.

Good parents have bad kids, and Vice versa. The child may actually be the reason they divorced.

College is optional for one thing and no one has a right to have others, even parents, pay for it.

Since when are any parents responsible for a child’s college education! High School Yes, but college?

No one helped me or my brother! We busted our behinds to get better educated!

Constitutionally requires a jury trial.

But we’ll just let judges rule by decree.

Not to mention that the daughter left their home and has no claim.

And once she’s over 18, she has no claim.

Well, no claim unless you’re in under a wacko legal system that encourages freeloader lawsuits.

I really want to know if married parents in NJ can be forced by courts to pay for college for their children, and even the choice of college?

This could only be a lib’s wet dream.

Good parents do have bad kids, and I feel sorry for them. When it’s drugs or mental illness, they have my deepest sympathy. If it’s just an entitled mentality, I do blame the parents. Occasionally that’s unfair, but it’s like a Navy ship running aground - the Captain is accountable whether or not that is fair.

If she were my daughter, she’d be dead to me.

She is like the alcoholic, always taking advantage of others and in dire need of quickly hitting bottom and realizing they need to grow up and stop treating loved ones mere objects, for their self serving life.

Is she not an adult at age 18? Why do her parents have any further obligation? Is it a mistake to ever have children if the courts make you responsible for them without limits?
