The dead sociopath was only about 10 feet from the officers and was at the top of a berm. He could have closed that ground very quickly and to avoid that the officers could not afford to hesitate to shoot.

He also easily could have taken a few steps over the top of the hill pulled a concealed gun and killed officers.

If you don’t want to be shot by the cops don’t threaten to murder them and resist arrest while brandishing knives.

You sound just like Reverend Al. Do you so think Michael Brown had his hands up and Tawanna Brawley was raped?

What about my linking to a story makes it what I am saying? I was just providing some additional background as to what transpired. I hadn't heard about this before yesterday thus I went on a search to find out more than what the article was presenting. Sounds like the police department has a history that makes them seem like cowboys (for a lack of a better word) that puts them in bad light. But is it the police or is it the citizens? I don't know. Another interesting tidbit that I uncovered was this:

The criminal charges were the first Brandenburg has brought against officers in a shooting. She is also waging a fight with the Albuquerque Police Department over allegations that she committed bribery while intervening on behalf of her son in a burglary case.

So is it payback? I also remember reading that the Feds refused to bring charges saying there wasn't enough there. I'm sure they saw the same footage. It's easy to see less than 1% of what transpired and jump to the wrong conclusion, that's all I am saying. Sorry, I don't listen to what the majority are saying, and I don't make decisions where I only see a scant portion of what transpired.

Anyhow, that’s just speculation, trying to change the subject and ignoring the facts of the case.

We have a dead man from an unnatural cause. Then you have a police officer, on tape and he has admitted to saying he was going to kill the suspect when he sees him. Surly you do not believe police officers that think the law does not apply to them should be on the streets?

IMO, that type of nonsense is what you see in third world countries, banna republics, police states, etc... It stirs up people and gets innocent police officers, like in New York murdered by Thugs that are looking for an excuse.

IMO if police officers are enforcing the law, then they should be held to the highest standards of the law, and not say oh the law does not apply to me.

"...top of a berm ... ." No he wasn't. The ground was very rocky and irregular making movement in any direction by an obviously overweight individual difficult at best. Did you even watch the video?

When the 21 foot rule is debunked, you attempt to change the conditions at the scene. Then, when you realize that you are on thin ice, you start calling me names. Not very effective in a debate.

Bottom line is that LEOs could have used available, non-lethal methods to subdue the subject. But no, it was shoot first, ask questions later.

The two officers who fired at the retreating, while turning away subject, committed murder.

He was a mentally ill vagrant. Ask yourself why the cops were even interested in this guy? Look where they are, out in the middle of nowhere. The guy was more of a danger to himself than seal team six wearing the go-pro cameras.

For all you James Boyd lovers and cop haters, here is Boyd’s history. It was only a matter of time before Boyd would have murdered a law enforcement officer or a civilian. And given the way the “justice system” treated him in the past, he most likely would have gotten away with the murder due to mental incompetency and been released to violently attack more innocent people.

Here is a timeline of James Boyd’s incarcerations and run-ins with police.

Jan. 10, 2002: Boyd is charged with battery on a peace officer in Las Cruces.

May, 2, 2002: He is sent to the state’s psychiatric hospital, the Behavioral Health Institute in Las Vegas, for forensic evaluation.

Jan. 29, 2003: He is found competent to stand trial.

July 17, 2003: He is sent back to Las Vegas for another forensic evaluation. Eight months later, February 2004, he is still found incompetent and continued treatment is ordered.

July 7, 2004: He is returned to the Doña Ana County Judicial Complex for competency hearing and on Sept. 9 is found competent to stand trial.

A month later, Oct. 20, 2004, he is involuntarily committed to the Las Vegas facility due to his mental illness and the case is dismissed.

March 3, 2005: Boyd is arrested for assaulting a man on Civic Plaza, telling him: “I am God and I want to hurt you.” He is charged with assault and battery and taken to jail. On July 27, the charges are dropped.

July 11, 2007: Boyd is arrested for disorderly conduct at Albuquerque Fire Station 1 on McKnight NW for pounding on doors and refusing to leave. He tells officers he is a government agent and keeps yelling that he will send them to prison and hell. He is arrested and taken to the Metropolitan Detention Center.

July 15, 2007: While in jail, Boyd is informed that, because of an infraction, he is to be put on a 23-hour lockdown. He becomes violent and begins hitting a corrections officer in the chest. The officer sprays Boyd with pepper spray. Boyd is charged with battery on an officer and resisting an officer.

Oct. 7, 2008: An order of commitment is filed to send Boyd to BHI in Las Vegas for treatment to competency so he can stand trial.

March 2009: Boyd pleads no contest to battery and resisting arrest. He is sentenced to time already served.

A month later, April 15, 2009: Boyd is arrested at St. Martin’s Hospitality Center after getting into a fight with another man and slitting that man’s face several times with a box cutter. Boyd is taken to MDC.

June 18, 2010, while still in jail for the incident at St. Martin’s, Boyd uses a food tray to break three windows of his cell, causing over $1,000 in damage.

August 2010: Boyd pleads no contest to aggravated assault in the St. Martin’s incident and no contest to the criminal damages charge. He is sentenced to 18 months, and gets credit for time already served.

Dec. 21, 2010: Boyd is arrested after causing a disturbance in the public library Downtown. He becomes verbally abusive, resists officers’ attempts to arrest him, then begins fighting with officers, breaking the nose of one of them. He is booked into jail on two counts of battery on the police officers.

March 15, 2011: While in jail for the battery charges, Boyd breaks the window of his cell by striking it with a dinner tray and threatens a correctional officer with physical violence. He is subsequently charged with criminal damage to property and assault on a peace officer.

Aug. 19, 2011: Boyd argues with a fellow inmate and a guard. He breaks three windows in his cell and has to be subdued with pepper spray. He is charged with assault.

October 2011: The charges from the dinner tray incident and from the St. Martin’s incident are dismissed due to mental incompetency.

March 2012: The charges from the library incident are dismissed due to mental health issues.

September 2012: Boyd is sent to BHI in Las Vegas for treatment to bring him to competency in connection with the assault from August 2011. Nearly a year later, August 2013, charges are dismissed after he is found incompetent.

March 16, 2014: While illegally camping in the Sandia foothills, Boyd is involved in another confrontation with police. This one proves fatal.

He wasn’t “just standing there” He was brandishing 2 knives after threatening to KILL the officers.

I don’t have a badge. Any police officer or private citizen would be 100% justified in eliminating that violent psychopath who was threatening them with knives.

I’d be willing to bet that in the same situation 99% of of freepers would have gunned him down, most much sooner. The other 1% would have been stabbed.

Your love for a sociopath who slashed and innocent man with a boxcutter, broke a cop’s nose, assaulted LEOs on multiple occasions and was threatening LEOs with knives is baffling.

You are attempting to change the subject, ignoring the facts and attacking the victim. Just because you can’t win a debate based on intellect. That does not mean your opponents are “haters”. That’s an illogical leftist tactic.

Personally I like cops and I am thankful for them. I know they have a tough job, but they have to follow the law just like the rest of us. However, that does mean they should be above the law.

This is not about Boyd or the two police officers being charged with murder. It’s way bigger than that.....
We are either a country of laws or we are not.

If police officers are allowed to be above the law and not be tried when they questionably killed someone. Then it’s only a matter of time before innocent cops are targeted by Thugs. Just like the tragic event in New York.

Plus when police officers are allowed to get away with breaking the law, then it’s only a matter of time before society breaks down. Then we are all living in h*ll hole. Do you want to really live and spend your off time in a h*ll hole? I don’t think you do or anyone does.

Look no matter where I have been in life. Unfortunately there is always a few bad apples. When they do bad things, like break the law, then they have to be held accountable. If not, then the reputation of the entire department because questionable. How is that fair to other people in the department that are roll models?

The above paragraph is what is at stake. Again it’s not about Boyd or the police officers. It’s about the law. We are either a country of laws or we are not.

My point is the officers did NOTHING WRONG. Boyd was a clear and imminent threat to their lives. The only error they made was in not shooting him much sooner.

When violent felons make violent threats, and are armed, they should be given ONE opportunity to peacefully surrender and then shot if they refuse. Failing to do this is putting the lives of innocent police officers and civilians in undue danger.

When you start threatening the lives of others, you have forfeited your right to live.

First off, he didn’t say he was going to kill him. Instead he said he was going to shoot his pecker. I think we are all guilty of letting frustration make us say things we really don’t mean. I am not saying he is guilty or innocent. What I am saying is I am not going to try the man in the court of opinion when I don’t have all of the facts. He may or may not be tried in court. That is how the system works, or at least how it should work. Innocent until proven guilty beyond the shadow of a doubt. My opinion should count for nothing.

The link in my first post worked fine, which is what I was referring to. The second link did have a problem where I was referring to the prosecutor, which didn't work. Let me try that link again. Source. I tried the link before posting and it worked. I usually do check my links. Not sure why this link did not work the first time.
