MONTGOMERY, Ala. (AP) Alabama's chief justice, who famously refused to remove a Ten Commandments monument from a state judicial building, has urged probate judges to refuse marriage licenses to gay couples even though a federal judge ruled the state's same-sex marriage ban.
Roy Moore sent a letter to Alabama probate judges on Tuesday saying they are not bound by the ruling because they were not defendants in the lawsuit and have not been directly ordered to issue the licenses. He said the federal court did not have the authority to allow same-sex marriages.
No federal judge, or court, should redefine marriage," Moore said in an interview Wednesday.
Moore said state courts, including probate courts, have the authority to interpret the U.S. Constitution independently, just like lower federal courts do, and the U.S. Supreme Court will resolve disputes over those interpretations.
The fiery Republican judge is no stranger to controversial remarks about homosexuality and the decisions of federal judges. Moore was removed as Alabama chief justice in 2003 after he refused to obey what he called an "unlawful" federal court order to remove a Ten Commandments monument from the rotunda of the state judicial building. Moore in 2002 called homosexuality "an inherent evil" in ruling against a lesbian mother in a child custody case.

This is the first time I have heard of a judge’s “Urge.”
I have heard of a judge’s order or ruling, but not an urge.
Meanwhile, Boehner says that the gutless House GOP isn’t going to fight the marriage case before the Supreme Court.

The states need to be a door stop for Federal courts on EVERY SINGLE MATTER where they don’t agree. Resist, ignore, drag out, re-interpret — fight them until and even after they threaten, fine and injunct until their faces turn red.

Hmm....California’s SCOTUS (a majority of the court, not just the CJ) ordered all state judges to not participate in Boy Scouts or risk disbarment.
Here we have a CJ (without the majority of the court, I suppose) urging but not ordering state judges to not follow the Federal judge’s order.
So they may follow it if they wish or not, I suppose.

The sell-out GOP will not have queer “marriage” as an issue in next year’s election. Like on immigration and abortion they have once again caved to democrats. The party in charge of the entire Congress is absolutely worthless. The official GOP platform will not mention family as it had done for the past 150 years. Faux News has been given their talking orders. Faux is loaded with “conservatives” like Goldberg and Krauthammer and Dennis Miller who have always been pro-abortion and pro-queer “marriage”, but people let them get by with calling themselves conservatives. That’s why the loudmouths on Faux News never mention all these renegade so-called judges that are overruling the will of the people state after state. From O’Reilly to Hannity to Meghan Kelly, all are in the tank with the queers and the destruction of marriage, which is the bedrock of civilization.
