Army Refuses Vet Benefits To Rape Victim

Joining the US Army at 19 years of age is an exciting and intimidating move. But with youth and vigor readily available, a promising recruit can climb the ranks of success and dream of a bright future.

DAN SICKMAN, non-attorney veterans’ advocate, is representing rape victim Diana Moore, from Bensalem, Pa., in her fight for justice and veteran’s benefits.

Diana Moore, who is now 29 and lives in Bensalem, Pa., never had that opportunity.

While stationed in Ft. Campbell, Ky. as an automated logistical specialist, she was raped by a superior.

Not only did she find no justice in the Army – she was arrested herself.

Rubbing salt in her wound, to this day she cannot get treatment from the Dept. of Veterans Affairs. The reason? It denies she ever served in the Army. Her records, it seems, have disappeared.

If you want to read about a case that will make you want to throw things read up on Stanley Friedman. WWII vet and it took them six decades and a lawsuit to find his records and then three more years for them to start giving him his benefits.

Believe it or not my husband still has all his orders in his military jacket from ‘54-62. They are kept as safe as any other family document and I’ve never seen the need for the file to be taking up room. Guess it makes sense now in light of this.

Hope this gets lots of attention AND ACTION! No one who served in the military should have to fight the BS bureaucracy once they are discharged.

Maybe a letter to the CIC or Debbie Wasserman Schultz - they always claim they’re a champion for women, whereas conservatives are hopelessly misogynist.

How about Hillary! or Michelle Obama? They’d be willing to get to the bottom of this...wouldn’t they?

The VA said my FIL was never on Enewetak. Since most of the records were classified maybe they were telling the truth about having no records.

But when looking though his records we found a letter of commendation for his work there.

Save the records. You never know what may be needed in the future.

After all a Data Repository near St Louis burned down after Vietnam. My wife had her Separation papers which the VA accepted and rebuilt her records without any problems.

What? No DD214?

I was thinking the same thing. A DD-214 is a very important document that one should safeguard. I have several copies made and have my original in a safety deposit box.

Something is up if she can't produce a DD-214. Everybody is given a copy when they get discharged or retire and admonished to safeguard it.

In the past few years I’ve cleaned out the files of several vets. They ALL had their DD’s in a safe place. From the privates through the master Sgts.

I kn ow one time a young female was on the duty roster for KP, when the CQ Runner went to wake her up, (It was an open bay), she screamed rape.

They lined up all the guys so she could pick him out, and she finally admitted the truth.

I don't know when they changed it, but when I was in you had to serve 180 days to get benefits, I believe now it is 18 or 24 months. I know of one person who was going blind during basic and they discharged him at 178 days, so he gets no benefits.

Also National Guard and Reserve don't get benefits. Unless under special conditions.

Military brass have a bad name when they make their name. Unless you are taught to mistrust people, be prejudiced, you usually do a first impression thing. Military brass are mocked by the boots, but respect is earned. I couldn’t imagine being responsible for so many lives and prayed that my son’s superiors would make the right decisions.

Diana should have her own records, check stubs, tax records, phone records, receipts, an army physical record maybe.

Nevermind whether the military service lost their end of the records.

She needs an investigator on this, or a knock on the door of the raper from unexpected guests.

I agree 100%. I have copies/originals of all my Army records from 71-78. I even have my copies of my Army medical records that I think the out processing people photo copied for me. I have all my orders, efficiency reports, and DD214s from 1971 to 1996. Something just is not right here.

Like I said earlier, if she didn’t serve the minimum time she doesn’t have benefits. Also it says she went to an outside Medical center for her diagnosis. The VA won’t except that.

Who is “they”? They may be more inclined to listen to her lawyer, if “they” turns out to be who I think it is.

Apparently for the present the wheels are only spinning in place until a small army of lawyers can bring some clout and consequences.

It’s like dealing with the IRS by yourself— it just isn’t done.

Very sorry for the stress of this situation. It looks bad without the kind of help that kicks in doors. (Rhetorically speaking, of course) :)
