Court in Japan rules that paying for sex is not adultery in landmark ruling

A court in Japan has ruled that a husband who sleeps with another woman is not committing adultery if the sex is a business transaction.

The ruling was made after a man's wife sought ¥4m (£20,830) in compensation from a club hostess who had a long-term sexual relationship with her husband, the Japanese newspaper Asahi Shimbun reported. . . . .

As long as the intercourse is for business, it "does not harm the marital relationship at all" the judge said. "Even if the wife is disgusted by the act, it does not constitute a legal offense," the judge added.

Japan is a totally alien culture. Don’t try and apply western values because the cultural motivations are often wildly different.

I was in Japan the day after Bill Clinton won his first election. It was a meeting with NEC. One of our hosts, over the pre-meeting coffee asked me: “preeeze to tell us about President Crinton’s ERECTION! There was a lot of coffee on the table after that remark!

In this case, the ruling is fairly narrow and regards civil suits.

Japan has home wrecker laws like parts of the United States once did. A person who forms a relationship with someone who is married and woos them away from their spouse (or causes the spouse to divorce them on the grounds of infidelity) can be held find fiscally liable for maintenance of the former spouse and any children.

So this ruling just clarifies that in the case of prostitution (which is often not voluntary) the fiscal onus is all on the married buy sexual.

Does it make more sense if you look at it in context?

Are you saying a woman who “steals” another woman’s husband can be financially liable to take care of the wife and children? That would explain the ruling. A prostitute isn’t “stealing” away the woman’s husband.

There was a time when some states had laws like that here.

Coupled with the absence of no fault divorce laws it was tough on philanderers who got caught. Of course, back in those noncomputerized days deadbeats could move across the country and take up a new identity.

Exactly...while not referring to Japan as an example here (we know there are far worse), you cannot compare American Christian Conservative values to cultures that belong in a petri dish.
