Horne v. Department of Agriculture.decision is a big win for those of us who try to make a living in Ag

Any net proceeds the raisin growers receive from the sale of the reserve raisins goes to the amount of compensation they have received for that taking. It does not mean that the raisins have not been appropriated for government use, nor can the government make raisin growers relinquish their property without just compensation as a condition for selling in interstate commerce.

This is a major blow to government's program of trying to boost prices by keeping crops off the market.

It is 5-4 as to at least some parts. Breyer, Ginsburg and Kagan partly concur, partly dissent. Sotomayor dissents in full.

Market value at the time of the Taking determines what constitutes just compensation.
Very good ruling.

Good. The government shouldn’t be taking away from people without compensating them.

Is there a national emergency in which such a condition might be best for the nation? Personally, I think all-out-war should require sacrifices from all of the nation and not just from the troops in harm’s way.

But we were in no such national emergency, so there was no good reason to be stealing raisins.

Sotomayor will default to siding with the government in oppressing hard-working decent folk and in siding with the criminal who preys on decent folk.

Anyone see a pattern here?

Good. That’s Step One.

The trouble is, as I see it, that govt is involved in ag at so many different levels, it may be very difficult to see the results of this decision at the checkout counter.

The good done here, may worsen something over there, but alleviate that... I can feature a variety of better or worse outcomes for various participants.

AND, too, it remains to be seen what Boehner will do to gve the win back to Democrat ag policy; can’t let the table tip too far toward Freedom and Liberty, yaknow...

The only Scotus Justice who thought that government simply taking the private property of citizens without compensation was Sotomayor.

Sotomayer took out the best cold medication product Zicam by Matrix and the company had to go bankrupt with fraudsters saying they had lost their sense of smell due to the product winning awards.

Besides, "they" say raisins have anti-oxidants and other important health benefits. Isn't it, to use a favorite word of the lib/prog types UNFAIR to keep their prices artificially high? Who's really raging a war on the poor?
