Supreme Court will re-hear Texas affirmative action

The Supreme Court said Monday it will dive back into the fight over the use of race in admissions at the University of Texas, a decision that presages tighter limits on affirmative action in higher education.

The justices said they will hear for a second time the case of a white woman who was denied admission to the university's flagship Austin campus.

After deciding against affirmative action in the Michigan case last year it “should” be hard for them to decide the other way in the Texas case.

Well, in this case the 5th Circuit Court (generally the most conservative) has taken the side of University of Texas. They are making it easy for SCOTUS.

The RIGHT decision would be to rule against Texas because its use of racial preferences is discriminatory. The only reason the sub-prime court MIGHT actually get this one right and rule against the use by Texas of racial preferences is punishment for the statements the Governor and AG have made against the same-sex marriage ruling.
