The licensing of marriage is statutory. In the absence of statutory authority, the state has no jurisdiction over marriage to issue a license. What the Supreme Court did was not to make homosexual marriage the law of the land, but to invalidate all state statutes that limited marriage to two people of the opposite sex.

As such no state that had not legalized homosexual marriage by legislation has any right to issue a marriage license to anyone.

Any state that issues a license to any homosexual couple is in violation of the law, not in compliance.

I'm hearing there's hesitation with licenses in many parts of the country right now. It's always seen as disobedience, but I imagine some of it has to be legal in nature -- worry about what the law actually is in their state.

Do you have any indication that there is legal puzzlement out there?

So we have 11 states that lawfully legislated same sex marriage and 39 that did NOT.

Dang, I was off by two.

Actually, there's more states that have banned gay marriage than those that have approved it. I count 16 that have specifically allowed it, 30 that specifically are 1man/1woman, and 4 that are 1man/1woman by statute but not Constitution. Federal judiciary tyranny doesn't count as a pro-homo state!

See above (#66), I’ve got a link to my old post from February. I counted 16 states that approved it (11 by pop vote or legislation), with 5 through the State courts. I included those under ‘approve’ as they were State-level courts, and the states did nothing to fight it or fix their Constitutions/laws to get by the courts.

30 States have Constitutional definitions of 1man/1woman, and 4 more have statutory definitions.

Which it, constitutionally, had no right to do.

The Constitution is very clear about what rights the Several States have.

IMO the states are free to conduct business as usual as the SCOTUS has overstepped its boundaries.

If SCOTUS makes a ruling that doesn't fit with what the Constitution allows, the ruling is not valid.

As your numbers say, same sex marriage was forced down the throat of the states by the courts.

The bottom line for me is an honest assessment: Whatever we’re doing is not working. They laid a steady foundation for these victories over the years. In society, they have taken over education, law, art, media, music, film, an entire political party in a 2 party system, and they are now in the process of taking over the military.

If we lose the military and the police, then we are in serious danger.

Is it possible to turn this around with this next national election? Only the immediate direction. Their foundation remains. But, at least it would be a start.

I also believe that the immigrant invasion and the minority war in our inner cities is a huge drain on the health of the nation.

Six years before the Supreme Court decision of 2000, Camille Paglia wrote that she thought the idea of their being openly gay scout leaders was “preposterous.” She wrote something to the effect of, “How would feminists feel about heterosexual men going into the woods overnight with prepubescent girl scouts?”

The other aspect of this is that the Boy Scouts is a faith-based organization that objected to homosexual behavior on theological grounds. Unfortunately, once the concept of “sexual orientation” was invented, it basically preempted people from having an opinion about sexual behavior — or at least this sexual behavior.
