I saw this video - if they want to protest THIS arrest I am going to be on their side this time.
Unlike idiot Michael Brown and Trayvon, this woman had no reason to be arrested - he is 100% responsible for escalating this rather than calming the situation down.
I know everyone’s instinct is to attack the cop, but he didn’t have anything to do with her death. DPS troopers do not have direct access to the jail cells at the county jail.
In TX, you are required to follow any lawful order given by an officer. You can complain later to his supervisors, the AG, the TX Rangers, but you must comply at the time.
It is standard procedure to ask someone to put out their cigarette because cops don’t want to breath in the smoke, the smoke often masks other smells from liquor or drugs, and because it is a safety issue since people have been known to burn cops with them.
In today’s environment, blacks, muslims, and illegals are getting extremely hostile against cops, even during minor traffic stops because they all think they can get away with it. This lady was an active member of the #blacklivesmatter protest so her attitude was probably extremely hostile. That hostility usually triggers suspicions in cops, thinking that the person could be hiding something or do something illegal, which is why he asked her additional questions. Again, that is normal protocol.
Once she refused to put out the cigarette, he could have walked away, but her refusal also gave him cause to pull her out of the car. If she had only gotten out of the car willingly, then he probably would have asked more questions and let her go. The fact that she refused to get out is why things continued to escalate. Her behavior set off big red flags.
I’ve seen this video compared to another video of a trooper in another State in which the driver was cussing at the trooper and actually tore up the speeding ticket. The trooper remained calm the whole time. The difference between the two encounters is that the guy in the other encounter followed the trooper’s orders, including the order to get out of the vehicle and pick up the torn ticket, and never touched the trooper. If that guy had not followed the orders or had kicked the trooper then he too would have been arrested.
She had a right to cuss and be disrespectful, but not disobey a lawful order. The trooper’s behavior may have been bad policy, but not illegal. However, her refusal to follow a lawful order was illegal.
And if he tells you to suck his c***, do you just do that as well? He didn’t have the legal authority to tell her to put out her cigarette. So why exactly should she have complied?
She failed to use a turn signal. For that she was pulled over. Okay, fair enough.
But the officer then gave an illegal order.
He was not authorized to tell her to put out her cigarette.
When she told him “no”, as she had every legal right to do, he overstepped his legal bounds and ordered her out of the car.
When she failed to obey that illegal order (again, no chain of authorization to give that order), he then forcibly removed her from the car.
He threatened her with use of a weapon (the taser). Note once again that he lacked authority from the point he told her to put out her cigarette.
He then claims he was assaulted while he was in the illegal action of assault and battery upon her. It’s not illegal to defend yourself from illegal physical action upon your person.
This is the type of lawman than give the ever shrinking number of good lawmen a very bad name.

He was selective in his choice of girls supposedly young ladies from the wrong side of the tracks etc.
Several times parents went to the chief over it but the behavior continued. Finally one incident got him a suspension for a few weeks. Then all of the sudden he was in the hospital with all manner of contusions and broken bones yet it never made the papers or on the radio. Strangely he never got reinstated and then he moved away shortly after getting out of the hospital.
When you ask anyone in authority at the time what happened they say he was in a skiing accident on Lake Alma. You all should note Lake Alma only allows pontoon boats and rowboats with small electric motors.
You should probably watch the sequence again. IIRC he was basically done with the stop at that point when he asked her to put out the ciggy.
I’m worried that people think it’s in now their right to resist arrest. To argue with a cop as to the righteousness of their arrest. To refuse to step out a car, or put hands up, or sit down when instructed, or whatever.
Or to put out an offensive cigarette two feet away, especially when politely asked, and by a cop.
Maybe because I’m a lawyer I know that you never resist arrest. Ever. It becomes a new crime if you do, even if the original violation is deemed later to be groundless.You just comply and argue it later. The street is not a court room.

He said ‘I’ll light you up’ instead of ‘I’ll taser you.’ Who cares? In tense, emotional situations (she resisted arrest and then kicked him, and cops always worry about none disclosed handguns) we use euphemisms. He didn’t call her names or use expletives as she used continously.

I have to say she was wrong. Not to die, of course. I guess it’s possible it was a retaliation. But not likely. It will be interesting to see what the ‘investigation’ shows (whatever they can investigate.)
No, if he tells you to do something like that or attempts to rape you then that is not a lawful order and you don’t have to do it.
You’re completely wrong. In TX, you do have to put out a cigarette when told and that is a lawful order. If you don’t like the law then change it, but other you must follow the law.
She was arrested for resisting arrest and assaulting a police officer. He had written her a WARNING for failure to signal and was about to send her on her way, when she became belligerent.
It amazes me that FReepwrs take the side of a radical, racist activists who believed that any black person has the the right to assault, rob or murder any white person and any white person who defends his or herself is a criminal.
You apparently don’t know TX law. It was a lawful order and the Trooper had the authority to order her to put the cigarette out.
Show me in the state statutes where it is a lawful order. He can order her to put the cigarette down. He can order that the person not smoke while he is speaking to them. He cannot order that she put the cigarette out.
I did see the sequence, but as I said, her hostility triggered a red flag and prompted him to talk further with her. She was still legally detained so the Trooper had the right to ask her to put the cigarette out for his safety and to determine if the cigarette was being used to mask other smells.
Read the Penal Code and CCP. You will see that it was a lawful order and within his authority.
The cop who pulled his gun in that other incident was being bum rushed by several individuals while making an arrest. That was completely justified.
It amazes me that there is no line that a police officer can cross that some freepers will not side with an out of control law man.

I’m not going to read the whole code. You have the burden to show me that it is in the code. You find it and show me. You claimed it was a legal order, if it is, then it should be easy to find.
The TX Ranger could have been called in to investigate that situation if the Chief refused to. This same situation recently happened in a small TX town by the Chief and the Chief was investigated and indicted by the TX Rangers.
Seems to me, he pulled her off camera, so no one could dispute whatever he did next.
