Walker, Jindal back Kentucky clerk on marriage licenses: ‘The Constitution is very clear’

Two more GOP presidential candidates have chimed in on the issue of whether Rowan County clerk Kim Davis must provide marriage licenses for same-sex couples.

While three candidates have publicly supported Davis' right to only provide marriage licenses for man-woman couples, three others have said she must do so or resign.

This morning, Wisconsin Gov. Scott Walker told Laura Ingraham, "In the end, this is the balance that you gotta have to have in America, between the laws that are out there, but ultimately ensuring that the Constitution is upheld. I read that the Constitution is very clear that people have freedom of religion -- you have the freedom to practice religious beliefs out there, it's a fundamental right."

Walker also said that he believes the Supreme Court erred in redefining marriage. That decision has led to Davis' circumstances, which include being in court today to face charges of contempt of court.

Yesterday, Louisiana Gov. Bobby Jindal, a trailing GOP presidential candidate, told Huffington Post that Davis was in the right. "I don't think anyone should have to choose between following their conscience and religious beliefs and giving up their job and facing financial sanctions," said the Catholic politician.

"I think it's wrong to force Christian individuals or business owners. We are seeing government today discriminate against whether it's clerks, florists, musicians or others. I think that's wrong. I think you should be able to keep your job and follow your conscience," he said. "I absolutely do believe people have a First Amendment right, a constitutional right. I don't think the court can take that away."

Who said she must issue the license or resign?

The pro-sodomy crowd are nothing if not vicious.
The supporters of the clerk are listed, the opponents are not. Threats to life are rampant, too, and the phone numbers of supporters are probably disseminated far and wide.

That the some of wannabe elected criminals are joining the pro-sodomy crowd surprises me, but it's their political funeral!

And that attendant was elected by her community and serves on a government-run airline?

Jindal's quote was, "I don't think anyone should have to choose between following their conscience and religious beliefs and giving up their job and facing financial sanctions." He didn't say only government employees.

When did "her community" become relevant in this mess? I don't see anyone asking "her community" if they want that marriage license issued.

The problem is that the exact same arguments can be applied by the Sanctuary Cities crowd that say enforcing immigration laws violates their religious principles as a “good” Catholic (whatever that means).

That was a possibility. Of course, she could have sued, and it would have been tied up in trial for a while. I don’t know why they didn’t fire her.

But in her job, if a license is not signed, it is not valid, right? So regardless of the specific meaning of “issue,” she was by withholding her signature failing to issue the license.

I love when our cases are filed most do not meet the ‘standing’ test, if we actually get to court and win then the other side appeals, delays implementing the courts decision (think Washington DC and the 2nd amendment case) and other stalling tactics. I have never heard of the other side going to jail for contempt of court for failure to following the court’s decision.
