Kentucky Clerk Kim Davis Is Meddling and Altering Marriage Licenses, ACLU Says

Kim Davis went back to work as a Kentucky county clerk last week after a stint in jail and a pledge that she wouldn't interfere with deputies who were issuing wedding licenses to same-sex couples.

But in a court motion filed Monday, the American Civil Liberties Union said that she was doing just that.

After returning to her job on Sept. 14 as the Rowan County clerk, the filing said, Davis "immediately" began meddling with licenses that the office's deputy clerk, Brian Mason, was issuing.

After returning to her job on Sept. 14 as the Rowan County clerk, the filing said, Davis "immediately" began meddling with licenses that the office's deputy clerk, Brian Mason, was issuing.

The ACLU, which is representing several couples who are suing Rowan County, called this "significant" interference that has "violated" a federal court order and "resulted in material alterations to those licenses that render their validity questionable at best."

The group is requesting that an older, unmodified version of the county's marriage license be used.

They got a damned marriage license. What different does the format make? If it works then go away and stop bothering people.

US District Court Judge Bunning saw no problem with marriage licenses which had been ‘altered so that “Rowan County” rather than “Kim Davis” appears on the line reserved for the name of the county clerk’ (footnote 1 of his September 8, 2015 order to Release Kim Davis) http://www.freerepublic.com/focus/f-bloggers/3339657/posts

They want her name on it. They won't be happy until they get what they want.

And then they'll want more.

Just say no. Say it now. Be done with it.

Gee I’m shocked. Usually the ACLU goes to great lengths to defend individuals of conscience from the power of government..sarc/off

That’s rich— the ACLU accusing someone else of meddling. It should be called the AMLU— Atheistic Meddling Leftist Union.

What different does the format make?

They need to break the opposition, much like forcing Winston Smith to love Big Brother in 1984 before killing him.

What different does the format make?

None if it was really just about getting a marriage license.

When the Supreme Court invalidated Kentucky's state laws regarding marriage, who has the governing authority to declare what constitutes a valid license?

It would seem that it doesn't matter what the form looks like as long as it is issued by the county.

This is purely prosecution of an individual.

More apt, IMHO: This is purely prosecution persecution of an individual.

The form shall provide for the entering of “The date and place the license is issued, and the signature of the county clerk or deputy clerk issuing the license.” KRS 402.100(1)(c)

KRS 402.110 Marriage license to be uniform and completely filled out. - The form of marriage license prescribed in KRS 402.100 shall be uniform throughout this state, and every license blank shall contain the identical words and figures provided in the form prescribed by that section.

“Rowan County” is not the name of the Rowan County County Clerk. Listing “Rowan County” as the name of the County Clerk is a violation KRS 402.100(1)(c), 402.110.

The gays want to have a trophy license to hang on their wall, just like a moose head with big antlers.

The deal was that she would allow her deputies to issue them if her name wasn’t on them.

This proves that the licenses were never the issue — licenses with her name on them were always the goal. That’s why her original stance was prudent — no marriage licenses for anyone — and BTW, fully supported by the very logic of the Obergefell decision.

According to a strict reading of the statute, if it said "Kim Davis", that's a violation too, unless the marriage licenses of every other county in the state say the same thing.

I agree Knarf. We’re just too timid to do it.

No just no, but hell no.

The form shall provide for the entering of "The date and place the license is issued, and the signature of the county clerk or deputy clerk issuing the license." KRS 402.100(1)(c)

Exhibited below is a properly filled marriage license. The date issued is "6/16/2015", the place issued is "in the office of KIM DAVIS, ROWAN COUNTY County Clerk, MOREHEAD, Kentucky", and the signature of the county clerk or deputy clerk issuing the license is "BRIAN MASON, DEPUTY CLERK"

I can't see the image in your post.

Do the altered licenses provide for entering the date and place where the license was issued, and a place for the clerk's signature?
