Sorry, Republican Governors: It’s Illegal To Not Accept Syrian Refugees Into Your State

The far-right wing in both America and Europe have seized on the Paris terror attacks as an excuse to turn away the thousands of desperate refugees who are fleeing the terror and violence of ISIS. Thirteen American governors (all Republican) have announced they will refuse to accept Syrian refugees in their states, demonstrating a remarkable ignorance of Constitutional law. As ThinkProgress noted, "the Supreme Court explained in Hines v. Davidowitz, "the supremacy of the national power in the general field of foreign affairs, including power over immigration, naturalization and deportation, is made clear by the Constitution." States do not get to overrule the federal government on matters such as this one."

Those declarations by GOP governors are riding the wave of Islamophobia coursing through the right-wing. Jeb Bush and Ted Cruz both proposed profiling refugees by religion and "only accepting Christians," because despite the fact that Christian terrorist attacks take place in our country on a regular basis, Cruz thinks "there is no meaningful risk of Christians committing acts of terror." Trump said that he would "strongly consider" shutting down mosques in America, completely contradicting his widely professed devotion for "religious freedom." Mike Huckabee called for the new Speaker of the House, Paul Ryan, to halt the "importation" of refugees or resign.

President Obama ripped these xenophobic bigots in his Monday press conference, chastising them for abandoning American values and buying into their own fearmongering:

"When I hear folks say that, well, maybe we should just admit the Christians, but not the Muslims, when I hear political leaders suggesting that there would be a religious test for which person who’s fleeing from a war-torn country is admitted, when some of those folks themselves come from families who benefited from protection when they were fleeing political persecution, that’s shameful. That’s not American. That’s not who we are. we don’t have religious tests to our compassion."

He is absolutely right. While there are certainly dangers we need to address, this kind of reaction from the right-wing is exactly what ISIS wanted. By reacting with fear and discrimination, we marginalize more Muslims and push them into the arms of extremists. The passport that indicated one of the attackers was a Syrian refugee is likely fake, and an obvious plant to inflame fear of refugees. These people are desperately fleeing their homes because the murderous horrors of the Paris attacks are a daily occurrence in ISIS territory – a mass grave of eighty murdered women was recently discovered in Iraq's Sinjar province by liberating Kurdish peshmerga units. It is our moral obligation to accept and protect the incoming refugees in the face of unthinkable violence.

Quote: “Those people emote rather than think”

We all have three sides. On one side is our Spock. The being of pure logic. It knows what makes sense and what is right with all emotion factored out. On the other side is our McCoy. Emoting and yelling at our Spock that it is a “green blooded, inhuman monster.” In the middle is our Captain Kirk, weighing each side and ideally coming out with a solution that is based mostly on Spock’s advice with a touch of McCoy’s humanity.

Unfortunately, the left has succeeded in killing Kirk and Spock and leaving McCoy driving the Enterprise. All emotion, all irrationality all the time. One need look no further than the college campuses.

t really doesn’t matter which states take them and which do not. They are a Greyhound bus ride from your town, once they arrive.

I’m wondering where Obama gets the constitutional authority to unilaterally declare that the United States will admit 1 single person beyond the legally agreed limits? Oh, that’s right... he doesn’t give a sh- about the constitution either.

Libs created sanctuary cities. Now we create sanctuary states. Suck on that, Libs.

It's our 'Safe State', terrorism makes us feel unsafe. #ourlivesmatter

"That the supremacy of the national power in the general field of foreign affairs, including power over immigration, naturalization and deportation, is made clear by the Constitution, was pointed out by the authors of The Federalist in 1787, and has since been given continuous recognition by this Court. When the national government by treaty or statute has established rules and regulations touching the rights, privileges, obligations or burdens of aliens as such, the treaty or statute is the supreme law of the land. "

It is true that no state can stop Obama from admitting and resettling Syrian Refugees.

But Congress can.

Which is a damn shame, because Congress will not stop anything Obama does.

Hey Colin, take some home to your family. And take some wolves too, while you are at it.
I am tired of the left forcing the rest of us to live with ***their*** choices.

Wasn’t there a point in time earlier this year where Barack Obama was REFUSING Christian refugees and only taking the muslims?

Actually that’s pretty funny stuff coming from Obama’s people: “It’s illegal ...” in these times when the law is, well, whatever Barry says it is.
Actually another said it bluntly, “The law is whatever is cogently propounded and forcefully defended.” Aaron Burr, fugitive and traitor.

The law is whatever the People say it is, not what a tin-plated tyrant decides suits his agenda.

Obama and to some extent, Clinton before him have simply made their own laws through executive orders which were not intended to be a non legislative implementation of whatever they wanted.

Of course the Courts have been doing the same thing since at least the Warren Court.

And it is those two things precisely which are responsible for most of the problems since FDR took office.

Of course the 16th and 17th Amendments laid the foundation for tyrannical, illegitimate government, but the abuse of the EO along with the Administrative State and its enabler, the Legislative Judiciary, are the nuts and bolts of modern Leftist hijacking of the Republic which once stood.

The states have put themselves in a position with the federal government as a welfare recipient, do it or we will stop the money. Most of the rat hole sanctuary cities are what they are because of the federal dollars OUR TAX DOLLARS pouring in. We the American people are indirectly supporting this. State governors need to take a stand

Clock is ticking, one year left - obama has to get enough jihadists here to pull off the ultimate “fundamental transformation of the United States of America” that he promised.

He is in full blown taqiyya mode until he achieves downfall of America.

"And who’s going to MAKE them take them?"

It's more a matter of how would a governor stop it?

The Federal Government will proceed. These governors need to know what their strategy is to stop them if they intend to do so.

Personally, I think it's all bluster for political effect as I don't belive any governor will call out the state police to stop a Federally contracted bus carrying nascent terrorists.

They just won't do it because they know in a day that bus will be escorted by National Guard troops that have been Federalized.

OF COURSE we need to force the Feds to do this at gunpoint.

But I don't think any of these governors have the guts for such a showdown.

Secession will solve any “legal” problems. It’s not rocket science.

We...dont...care...what...you...think! No refugees unless they can be 100% verified that they are not terrorists. You like them so much, open your home to them.
