Full title: Obama's Executive Gun Control: No Minimum Threshold Before Private Gun Sales Require Background Checks

On January 4, the White House released a fact sheet which previews the executive gun control Obama will announce Tuesday, and it reveals there is no numerical threshold of sales that a private seller has to cross before being considered "engaged in the business of dealing in firearms."

In other words, previous hints that there would be a "trigger"--a certain number of guns that a private seller had to sell before being considered "engaged in the business"--are now out the window.

Figures like those reported by NBC News, wherein they quoted sources saying, "the administration has considered 50 or 100 guns a year as the threshold to trigger these requirements," have been discarded. A more fluid system--whereby any private seller can be considered "engaged in the business of dealing in firearms" regardless of the number of guns he sells or the frequency by which he sells them--seems to be what Obama has in mind.

And the language of the executive gun control shows that private sellers who occasionally advertise online or sell at gun shows can certainly be considered "engaged in the business" and, therefore, required to get an Federal Firearms License (FFL) and go through background checks each time they sell a gun.

So, in other words, they want no private sales at all. . . at least not among law abiding folks. Criminals will still steal guns or use straw purchases and sell guns to whoever has the cash or drugs to trade for them.

If this concerns what would have been considered private sales between non-FFL holders would it also come into play with a private person selling TO an FFL holder? In other words, if I want to sell a firearm to a licensed dealer because I no longer want that gun do I need to get an FFL just to do that?

What a mess!

Unenforceable laws are unenforceable. 200 extra ATF agents can’t do jack squat with the thousands and thousands of FTF transactions that will still go on.

Barry is doing this for his legacy but its going to be huge egg on his face for him and the DemoRATS.

Cruz will trash this EO on day 1.

The requirement to get the FFL is arbitary and will take months,the fee also is excessive

Another words,the immediate stoppin of gun sales

I remember when GW refused to veto the CFR bill.....campaign finance reform.... He said it would be struck down by the USSC. Guess what? He did’t veto it, it was ruled lawful, we are now stuck with regulations making it harder for grassroots to engage in politics...... think Lois Lerner and 501c3 regs and political gamesmanship....Yeah, I trust the GOP.....NOT.
