I called it! This is what Bloomberg et. al. got passed in the state of Washington. Although it is for gun “transfers”. Legally I can’t even let my adult son shot my gun at the range without an FFL. (It IS spelled out in the 18 page law that I can loan my gun to my spouse at a registered range. But not while plinking out in the woods.)
I am guessing that obama’s decree will also use the word “transfer” instead of sales.

Mine are tied up in our Trust funds and assigned to who they go to. Trust funds don’t go through probate, nor subject to lawsuits.

With no minimum “trigger”, every private sale would require a background check (associated with the serial number of the weapon). Later they can require non-sale transfers as well.
Just like in 1984, they don’t intend to enforce all the laws, they just want everyone caught up in the web, so that anyone can be prosecuted for something, anytime they dare to speak out against the party.

Using the same logic....if I were going to sell my car....I’d be a registered dealer before I could conclude the deal. If I were selling my property without a real estate company involved....I’d have to be a registered real estate dealer before I could conclude the deal. If I were going to sell lemonade in front of the house as a ten-year-old-kid, I’d have to be a registered dealer. If I were going to sell cattle from my farm, I’d have to be a registered cattle dealer. If I was going to have a garage sell or sell a truckload of junk at a flea-market, I’d have to be a registered dealer of some sort.
For some reason, I don’t see this lasting too long. There’ll probably be a dozen states by March which put up state laws to note that the cut-off will X number of weapons and openly challenge the EO.

If you read the actual fact sheet, it seems like nothing much is being changed on private sales. It is merely “clarifying” that the current regulations already exist. It already doesn’t matter where you sell the guns and according to the fact sheet courts have already held that a small number of sales could be “in the business” depending upon other factors.
Seems like a bunch of hype to convince the Left he is “doing something” on guns. He might be doing this so Democrats will be able to convince their anti-gun base that there is now no need for any unpopular anti gun legislation that would hurt them in the 2016 elections.

Clarify that it doesnât matter where you conduct your businessâfrom a store, at gun shows, or over the Internet: If youâre in the business of selling firearms, you must get a license and conduct background checks. Background checks have been shown to keep guns out of the wrong hands, but too many gun salesâparticularly online and at gun showsâoccur without basic background checks. Today, the Administration took action to ensure that anyone who is âengaged in the businessâ of selling firearms is licensed and conducts background checks on their customers. Consistent with court rulings on this issue, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has clarified the following principles:A person can be engaged in the business of dealing in firearms regardless of the location in which firearm transactions are conducted. For example, a person can be engaged in the business of dealing in firearms even if the person only conducts firearm transactions at gun shows or through the Internet. Those engaged in the business of dealing in firearms who utilize the Internet or other technologies must obtain a license, just as a dealer whose business is run out of a traditional brick-and-mortar store.Quantity and frequency of sales are relevant indicators. There is no specific threshold number of firearms purchased or sold that triggers the licensure requirement. But it is important to note that even a few transactions, when combined with other evidence, can be sufficient to establish that a person is âengaged in the business.â For example, courts have upheld convictions for dealing without a license when as few as two firearms were sold or when only one or two transactions took place, when other factors also were present.There are criminal penalties for failing to comply with these requirements. A person who willfully engages in the business of dealing in firearms without the required license is subject to criminal prosecution and can be sentenced up to five years in prison and fined up to $250,000. Dealers are also subject to penalties for failing to conduct background checks before completing a sale.

Buried deep in the EO will be language that allows confiscation of weapons for noncompliance. They will overreach... again.
