Bad news for Ted Cruz: his eligibility for president is going to court

The problem: the meaning of "natural-born citizen"

Here is what the Constitution says about who can be president:

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

The problem is the Constitution doesn't define "natural born Citizen." Neither does any current law. And no one has ever brought a court case to decisively settle the question as a matter of US law.

There are three ways someone can be a US citizen. He can be born in the US (regardless of who his parents are). He can be born outside the US to at least one US citizen parent, as long as certain criteria are met (those criteria are set by federal law and have been changed over time). Or he can immigrate here and then successfully apply for citizenship, a process called naturalization.

Everyone agrees that the first category of people are natural-born citizens. Everyone agrees that the third category of people are not natural-born citizens (regardless of how unfair it might be that immigrants can't be president). But Ted Cruz is in the middle category, and this is where the meaning of "natural born" starts to get fuzzy.

He is still in the race so he can legitimately sign on as a plaintiff to both Cruz and Rubio qualification law suits. That’s his only purpose at this time.
Bush drops out these two are disqualified that leaves Kasick Mr T and the good Doctor.

if Cruz had never left Canada for the first 30 years of his life and had never been to the USA he could still become President if he just stepped across the border and changed his residency for 14 years and then talked enough people into voting for him all because his mother was born in the USA.. is this a great country or what?

how is he supposed to put it to bed when it ultimately requires a court to rule on which can’t happen until one is actually a candidate and even then not until someone with standing files a suit?

that’s got to be the stupidest reason I’ve ever heard to not support a candidate! “I’m pulling my support because this guy didn’t deal with an issue that he had no possible avenue to deal with”

Circuit Court of Cook County, to be heard by Judge Maureen Ward Kirby. It is the next step, following an adverse ruling against Lawrence Joyce, rendered by the Illinois Electoral Board on the 1st of February.

[Other than to sell books. Why is Ben Carson still in the race?]

To continue to keep votes from going to Cruz.
AKA: Payback for Iowa

I agree. Getting this nonsense out of the way will help Cruz and make Trump look like even more if a Lefty buffoon.

As a Cruz supporter, I actually see this as good news.

So do I. Let's settle this crap.

No peon has "standing" to question a candidate's bona fides.

Only someone running for the same office might (or might not) have standing.

Panamanian born McCain certainly wasn't going to open that can of worms!

letting the Democrats take advantage of it after a potential Cruz nomination, when it’d be too late

That is the whole point!

Either resolve it now, in court, or Cruz should drop out.

The problem is the Constitution doesn't define "natural born Citizen."

And the Supreme Court is never going to define it. They will not touch this question and Cruz will be on the ballot.
