Attorney General Loretta Lynch indicated Wednesday that the law doesn't require the Justice Department to pursue criminal charges against Hillary Clinton for her use of a private email system, even if the FBI recommends criminal charges.
Lynch was asked in a hearing by Sen. John Cornyn, R-Texas, what her department would do if the FBI were to recommend that step. "If the FBI were to make a referral to the Department of Justice to pursue a case by way of indictment and to convene a grand jury for that purpose, the Department of Justice is not required by law to do so, are they — are you?" Cornyn asked.

Obama will pardon her even if she is indicted. She’s not going to see jail time.
You can’t pardon anyone of a crime that they haven’t been convicted of yet. So no trial, no conviction and no pardon. Then the next president is free to set his dogs loose on the criminal Clintons.

Does the FBI have to get DOJ’s approval to charge her? They do plenty of indictments on their own.

Ford pardoned Nixon for crimes which may have been committed related to Watergate. I forget the exact legal language used, but Nixon had not been indicted or convicted of anything at the time Ford issued the pardon. So it appears that a pardon can be issued without a conviction of a crime.
That’s my read. She can’t commit without Obama’s say so. The media has done a great job of confusing the mishandling of the classified emails. They may think they can duck the issue of charging Hillary. Not so her aids.
What’s coming down the road is explosive.
The FBI may not be directly involving DOJ attorneys in that because they haven’t needed to issue subpoenas. The immunity did involve DOJ attorneys.
Overall, I think Lynch is stalling for time.
Anti-Cruz John Cornyn happy they won’t charge the beast.
Comey. He would recommend it at least. Then, the DOJ would likely refuse to charge but the damage to Clinton would be done. And, as an added bonus, by refusing to charge Clinton, Lynch and obama have destroyed theor legacy.
Comey is a good man. And no pushover.
Don*t forget - Rahm Emmanuel was Clinton*s Chief of Staff.
He went on a *vacation* to Kenya shortly after Obama was sworn in.
Who *vacations* in Kenya?
For what, the food? The great hotels? The historical sites?
Do you suppose Rahm uncovered proof of Obama*s Kenyan birth?
Do you suppose he may have shared that proof with the Clintons?

If The Former Twelfth Lady loses in November she’ll almost certainly be pardoned on the morning of 1/20/17.And if she wins...it’ll be interesting to see if she pardons herself at any time before leaving office.
Obama is having Lynch stall. They acted tough; now is time to soft-pedal it. All for show.
I’ll be surprised if anything happens. Which is ridiculous.
