FBI Rewrites Federal Law to Let Hillary Off the Hook

There is no way of getting around this: According to Director James Comey (disclosure: a former colleague and longtime friend of mine), Hillary Clinton checked every box required for a felony violation of Section 793(f) of the federal penal code (Title 18): With lawful access to highly classified information she acted with gross negligence in removing and causing it to be removed it from its proper place of custody, and she transmitted it and caused it to be transmitted to others not authorized to have it, in patent violation of her trust. Director Comey even conceded that former Secretary Clinton was “extremely careless” and strongly suggested that her recklessness very likely led to communications (her own and those she corresponded with) being intercepted by foreign intelligence services.

Yet, Director Comey recommended against prosecution of the law violations he clearly found on the ground that there was no intent to harm the United States.

In essence, in order to give Mrs. Clinton a pass, the FBI rewrote the statute, inserting an intent element that Congress did not require. The added intent element, moreover, makes no sense: The point of having a statute that criminalizes gross negligence is to underscore that government officials have a special obligation to safeguard national defense secrets; when they fail to carry out that obligation due to gross negligence, they are guilty of serious wrongdoing. The lack of intent to harm our country is irrelevant. People never intend the bad things that happen due to gross negligence.

We might know what’s in his report but when the MSM gets done with this announcement she’ll look as clean as the driven snow. His job was to investigate and turn over his findings. He was judge and jury. Sorry, but he failed.

You're doing what you say the MSM will do. You're refusing to see the complexity of the situation, and how Comey defeated it. He proved she is guilty - that's the report. He also protected the report by drawing the wrong conclusion about it, and making it really, really clear that he made the wrong conclusion. You think the Director of the FBI can't lie better than this? He WANTS everyone to see that his conclusion is wrong!

She won’t need a pardon, because she won’t be convicted of anything.

She’s completely immune to prosecution under these clowns. She could explode kittens on television and nobody would dare indict her.

The republic is dead. It was nice while it lasted.

Under the federal statutes that outline penalties for mishandling classified, intent is literally irrelevant. Either you followed the rules for creating, transmitting, storing and safeguarding classified material, or you didn’t. Clearly, Mrs. Clinton violated all of those requirements, on a daily basis. Yet, no “reasonable” prosecutor would bring charges.

I’ve said it before and I’ll repeat it again: the seminal scandal of the Clinton era was the unauthorized access of FBI background files. Not only did it yield dirt on almost a thousand prominent Republicans, it also opened up new avenues of digging on many, many more. Truth be told, the amount of information gathered over the past 25 years is staggering. Ever wonder why so many Republicans cave so quickly? In many cases, it goes back to the mother lode of op-research, which began with the background files.

The real question: what do the Clintons have on Mr. Comey? We know that John Roberts is supposedly vulnerable due to an overseas adoption that may have been illegal. The dirt on the FBI Director is probably far worse.

As one who once held top secret clearance at my job, Hillary can not be cleared based on what she did, which is basically mis-handling classified material. Every time I was in a meeting where classified material was discussed, it was ALWAYS in a secure conference room. Now, sadly politicians have superseded laws.

Comey added, “Nonetheless, let me again remind you that laws and indictments are only for the little people, and Hillary Clinton is simply too important of a person for the application of laws designed for unimportant people to follow. Therefore my hands are tied.”

After the clear Treason of the “Iran Deal”, why should we think the Senate would care to get involved? They’ll just wring their hands and say “We can’t do anything, the FBI isn’t under our authority.”.

A year ago, a Folsom Naval Reservist was Sentenced After Pleading Guilty to what Crooked Clinton walked away from, see comments above from Comey.

SACRAMENTO, CA—Bryan H. Nishimura, 50, of Folsom, pleaded guilty today to unauthorized removal and retention of classified materials.

U.S. Magistrate Judge Kendall J. Newman immediately sentenced Nishimura to two years of probation, a $7,500 fine, and forfeiture of personal media containing classified materials. Nishimura was further ordered to surrender any currently held security clearance and to never again seek such a clearance.

Nishimura was a Naval reservist deployed in Afghanistan in 2007 and 2008. In his role as a Regional Engineer for the U.S. military in Afghanistan, Nishimura had access to classified briefings and digital records that could only be retained and viewed on authorized government computers.

Nishimura, however, caused the materials to be downloaded and stored on his personal, unclassified electronic devices and storage media. He carried such classified materials on his unauthorized media when he traveled off-base in Afghanistan and, ultimately, carried those materials back to the United States at the end of his deployment.

In the United States, Nishimura continued to maintain the information on unclassified systems in unauthorized locations, and copied the materials onto at least one additional unauthorized and unclassified system.

Nishimura’s actions came to light in early 2012, when he admitted to Naval personnel that he had handled classified materials inappropriately. Nishimura later admitted that, , he destroyed a large quantity of classified materials he had maintained in his home. Despite that, when the Federal Bureau of Investigation searched Nishimura’s home in May 2012, agents recovered numerous classified materials in digital and hard copy forms.

The investigation did not reveal evidence that Nishimura intended to distribute classified information to unauthorized personnel.

This case was the product of an investigation by the Naval Criminal Investigative Service (NCIS) and the Federal Bureau of Investigation. Assistant United States Attorney Jean M. Hobler prosecuted the case.

The investigation did not reveal evidence that Nishimura
(intended to distribute classified information to unauthorized personnel.) So Nishimura’s lawyers will be going to a federal court to get his sentence reversed and multi million $’s in damages due to this abortion of justice for Clinton.

Ballot Box NOPE. Laws are systematically being ignored, even altered to screw traditional, working class, white, christian, gun owning citizens whilst protecting corrupt, oligarchic, elite behavior.
