The Supreme Court of Virginia has ruled against Gov. Terry McAuliffe’s order restoring voting rights to more than 200,000 felons who completed their sentences, a decision that dealt a major blow to the Democratic governor and has implications for the November presidential race in the crucial swing state.
In a 4-3 ruling issued Friday, the court ruled that McAuliffe overstepped his clemency powers under the state constitution by issuing a sweeping order in April restoring rights to all ex-offenders who are no longer incacerated or on probation or parole.
The court agreed with state Republicans who challenge McAuliffe’s order, arguing voting rights should be restored on a case-by-case basis.

I have to admit, this straddled that line of executive powers vs legislative powers. Had the governor said ‘if you’re a convicted felon who has completed your sentence, go to the website, fill out the form, and your voting privileges would be restored,’ I think the decision would have been the other way.
Instead, he by default passed legislation - since legislation can’t be created and approved by the executive alone, it was struck down.
4 vs 3, though, things are getting close everywhere.

I remember civics class in 1973 we learned that felons loose their right to vote. It was a big thing back then. The right.
This is one of the reasons why True The Vote And other voter fraud prevention groups are going to be really busy this year.

I.e. if it had been petition driven, even with a super-easy petition process, then approving any number of received petitions would have passed muster.
If so — McAuliffe was too clever by half. On the other hand maybe he hoped this hail Mary would get by, knowing that a lot wouldn’t care to apply and might need rousting out at the last minute to be bused to a poll.
