White House won’t rule out Clinton pardon

The White House refused to rule out Wednesday whether President Obama might grant a pardon to Hillary Clinton to spare her from President-elect Donald Trump prosecuting her after he takes office.

White House press secretary Josh Earnest said Mr. Obama is hopeful that Mr. Trump will follow long-standing tradition of not punishing political opponents through the criminal-justice system. He said all clemency actions go through a formal process...

Easily. Ford did it with Nixon. They just give a blanket pardon for all crimes from X date to Y date.

One thing to keep in mind, though, is that only works for FEDERAL crimes. State level crimes are up to the state in question.

He’s going to have to pardon her. Can’t have loose ends leading to something much much worse taking out the whole party. The corruption was so thick and widespread, many folks in DC were anxious their name would turn up in the paper on any given day. I think if he pardons her, the risk of an future investigation becomes so low, it puts a lot of other people at ease.

I don't think a President can prosecute a private citizen or have someone else prosecute her. Hillary holds no office. She is a private citizen. It is now up to law enforcement.

Just because Nixon was pardoned does NOT mean that he could not have been taken to trail after he left office. We don't know what a Nixon pardon meant because it was never challenged as no attempt was made to pursue trying him.

If 0bongo pardons Hillary, it means SHE IS GUILTY OF A CRIME. If she is guilty of a crime then arrest James Comey and Loretta Lynch IMMEDIATELY because they refused to recommend her for indictment.

As a police agency, the FBI can’t actually file any charges.

Maybe we’ll have a Kabuki dance here in which Loretta will go ahead and book Hillary, and then Barack will step in and pardon her.

Wouldn’t there have to be a charge before a pardon? How can Obama know what to pardon, unless he is aware of her crimes?

I hope to God this does not rest. Drain the swamp was a huge reason for votes.

Does this mean Hillary can commit any crime she pleases for the rest of her life and is immune from prosecution, because I guarantee you she’s not going to suddenly become a saint.

No, you are wrong. Its what she did WHEN she was in office.

The fact of the matter is that she would likely be subject to a DOJ investigation because they would have access to the necessary information/evidence held within the government records.

Are you not aware that DOJ investigates private companies and citizens all the time?

The USSC ruled some time back that a police agency isn't legally liable for squat, as far as effectiveness is concerned.

I really wish people would do some searching before asking questions like yours.

For starters, read Ford’s pardon of Nixon to see how it is done.

Secondly, the Garland case and the Murphy challenge answer whether Obama can do it.

Third, the question you should really be looking at is Clinton’s pardon of Marc Rich’s RICO acts and whether that was legal.

Because that is where the challenge could lie with Obama and his pardon of the Clintons.
