Trump plan calls for nationwide concealed carry and an end to gun bans (Flashback)

Republican presidential frontrunner Donald Trump -- who said he has a concealed carry permit -- called for the expansion of gun rights Friday, including making those permits applicable nationwide.

In a position paper published on his website Friday afternoon, Trump called for the elimination of gun and magazine bans, labeling them a "total failure."

"Law-abiding people should be allowed to own the firearm of their choice. The government has no business dictating what types of firearms good, honest people are allowed to own," Trump wrote.

Here in MA, it takes hours of state-mandated training, hundreds of dollars in fees, and a month-3month wait for the police to process your request for a concealed carry permit, and whether you get it or not is at the sole discretion of the town police chief. Some chiefs are pro-2A and make the process as smooth as legally possible, others require additional paperwork above and beyond the already hefty state minimum, some have a blanket policy of not issuing CCW permits.

Not to mention, in July the lesbian AG did an end run around the state leg. and declared by fiat that ARs, AKs, and anything similar to be illegal for purchase, and that anyone who already owns one, owns it on borrowed time.

I'd love to see a conservative SCOTUS throw all of this nonsense out the window.

This is a federal issue because of the applicability of the second amendment to all the states. If the USSC determines these state laws that ban or infringe in any way on keeping and bearing arms, then the federal determination applies across the 50. The Heller decision mentions reasonable limitations so if those limitations are addressed at the federal level, they apply everywhere in the US and its territories. Many issues are state determinations, however, this, the second amendment to the US Constitution, is a restriction on the government, federal and states.

Those restrictions in states like HI, CA and NY would fall by the wayside.]

I am in the People’s Republic of New Jersey.
Only state that has more restrictive gun laws is NY.

I HOPE Pres. Trump can do something to override NJ gun laws!! The 2A should not be regulated by the 10A!!!

Yes, but he hasn’t spoken very much about it on the road.

Granted, he’s been spending his campaign time if 2A friendly states, so they aren’t particularly his audience for that, but he could have pumped this hard into ads in NY, and NJ. Would have gotten a lot more votes in these blue states!!

In theory I agree with you. The problem is the state laws. Trump’s plan will set aside all the state laws that are so variable, confusing and unconstitutional from state to state. Actually Trump’s plan is simply a clarification of the Constitution.

That said while the right to bare arms is protected, I’m not sure the right to concealed carry is in a strictly constitutional sense. Therefore having a uniform law for all states framed within the the 2nd Amendment would clarify the issue considerably.

He also needs to scrap the ATF forms on Short barrelled rifles and suppressors, $200 tax stamps required for an eight month wait on a can, come on...

I used to agree that firearms laws were states rights issues. However, the Second Amendment is not a states rights issue, it’s a Constitutional right. Adoption of the real intent of the 2A should preclude all fed-gov and state interference. The only interference with the 2A should be federal bans on gun ownership by convicted violent criminals and clinically insane (re: Democrats, hehe). It us up to us, citizens, to ensure that the federal government follows the 2A, remembering it is not in the constitution to ensure we can hunt and sport shoot, but to overthrow tyrannical government when necessary.

I mentioned it earlier in the week. It’s an amendment for goodness sake!!! abortion and gay marriage aren’t.

SHOULD NOT be up to the states.

I will push for this because this state decision stuff is nonsense and against the wishes of the founding fathers.

Speaking of Drivers licenses, Trump ought to declare that any state that issues DLs to illegal aliens to be invalid id for boarding a plane.

Very much so. I want don’t want one centralized control. I want 50 decisions and the decision closer to home. The state can coordinate licenses which is being done.

The federal government can coordinate this effort but no more than that.

I suppose you want a permit for your free speech rights from the federal government.

Does it not say the federal govt shall make NO LAW regarding guns, yet YOU will endorse them to do so? I thought we were fighting against centralized control. There is a reason our founding fathers limited federal government.

The only down side I see is that the gun stocks are getting HAMMERED.

I mean, how many 16" M4A3s do people need when for the next 4 years they will be able to just go out and buy them? I for one plan on shooting more in coming days but I'm concerned that some folks may be BLOATing less. We need to maintain our stockpiles.

This is really a state issue and should remain so.

This is not a state issue. First, the US Constitution trumps (pun intended) state laws. The 2nd Amendment applies equally to every state in the union. There should not even be any state laws restricting gun rights. Second, even if there are state laws, the US Constitution stipulates that all states must honor laws of other states.

My CT driver's license is valid in any state. My wife and I were married in NY and our marriage is recognized in any state. My CT CCW permit should be recognized in any state. Period. End.

This is only the first step in fully restoring 2A.
