Green Party's Jill Stein To Seek Intervention Of Federal Court In Pennsylvania Recount Bid
RT News ^ | December 4, 2016

US Green Party candidate Jill Stein said her campaign will appeal to a federal court on Monday to seek a state-wide vote recount in Pennsylvania, hours after dropping a lawsuit in a local court, saying the cost of the lawsuit was too high.

"Make no mistake - the Stein campaign will continue to fight for a state-wide recount in Pennsylvania. We are committed to this fight to protect the civil and voting rights of all Americans," Jonathan Abady, the lead counsel for Jill Stein's recount bid, said in a statement on Sunday.

"The barriers to verifying the vote in Pennsylvania are so pervasive and that the state court system is so ill-equipped to address this problem, we must seek federal court intervention," the statement added.

As a result, Stein is expected to file a new lawsuit with a federal court to demand a state-wide recount "on constitutional grounds," Abady stressed.

It’s so pathetic. It’s disgusting. Of course both Obama and Hillary should be publicly saying “stop it already” but we know they won’t. What’s also pathetic is the double standard, of course if this were republicans the media would be going nuts.

If they “win” just what on earth do they think will happen? We’ll all just say “oh, apparently she won fair and square”? These people know it - they’re looking to destroy this country, they know what will happen.

There you go. Besides that by not following all of the actions allowed to her in Pennsylvania court’s she’s stuck. She has not exhausted her actions and screwed herself by not following Pennsylvania law and deadlines.

Dr. Jillary Clintonstein’s attempt to reanimate HRC’s corpse in federal court will be interesting.
1) Stein has zero chance of a recount elevating her even to 3rd place, much less winning, so she has suffered no damage, and the remedy she seeks will not benefit her. She therefore has no standing.
2) She is obviously acting as a proxy for Clinton, which means all her court filings are in bad faith. Sanctions for frivolous filings?
3) PA state court provided a legal venue for pursuing a recount, but Stein withdrew her suit rather than pay a reasonable fee for the cost of her vanity recount.
4) Her excuse for not paying was lack of funds, yet she boasts of having raised $7 million.
5) She paid Wisconsin $3.5 million to pursue her farcical recount there, demonstrating agreement in principle that a 4th place candidate should pay the cost of a vanity recount.
6) Unless her recount funds have been embezzled, most of the remaining $3.5 million should be available. Claims that it has all been spent on lawyers are absurd. Provide an accounting for every cent. She is lying about her reasons for changing to federal court.
7) If she’s blown $3.5 on legal fees for zero results so far, what is her budget for the federal suit? Maybe she could have chosen to pay the $1 million to PA instead of spending $2 million on lawyers for the federal suit?
8) Stein has no evidence of fraud in the vote counting stage. A hand recount would change a pittance of votes “miscounted” because of the voters wrote in “You go girl” instead of her name. (She’s not investigating registration and identity fraud which is the Democrat fraud really occurs).

Good luck with that federal suit.

As Barky has stated: “Voter Fraud? How does that happen...it’s up to the States, we have nothing to do with it”....

So taking that remark, as weak as Barky is, I would tell this Jill idiot that it’s not the Federal Courts that over turn ‘voter fraud’ if anything it’s the Supreme Court that would be involved: Bush VS Gore...

But considering that the libs haven’t got two brain cells to rub together, they do not understand words and their meanings, in other words, they don’t know how to read, and they don’t listen to anything but the ‘voices in their heads’ because Liberalism is a Mental Disorder: Doing the same thing over and over again expecting a different result...

See Post 16. It’s a federal matter if she alleges the Equal Protection Clause was violated.

And this is no doubt what they have in mind. Only some counties are recounting. Never mind it is of her own doing.

Among other problems she will face however, is the safe harbor ruling as in Bush v Gore.

Hopefully PA certifies before any sort of ruling can be made by a Federal court.

... it seems to me that a federal court has no jurisdiction ...

Stein's lawyers will have to prove that the PA election laws are unconstitutional.

If I recall correctly, the SCOTUS already ruled that states have the right to make their election laws. If they violated the Constitution, they would have been changed a long time ago.

I just saw Stein interviewed by Chris Wallace. I was surprised at how batty she comes off. She has no argument whatsoever and she tried to obscure it by fast talking.

What is equally disgusting is just where the hell are the Republicans? Ryan, McConnell, Congressmen and Senators should be calling out and mocking Clinton and Stein for this attempt to undermine Americans confidence on our elections. Pathetic.

While most of us here are discussing this from a logical and legal point of view, we must always remember how irrelevant that is when dealing with liberals. In the end this will be nothing more that a successful or unsuccessful expedition in judge shopping. Which seems to usually work in favor of liberals.

The law be damned.

What is equally disgusting is just where the hell are the Republicans?

Where they usually are, MIA.

I am thinking we may indeed have our third party. Trump. Based on the actions of the Republican Party.

The good news is that this time we have a Republican who fights back.

Trump has very expensive election law attorneys engaged in this madness. Which is why Trump is free to continue adulting.

“Assuming the Constitution actually matters, it seems to me that a federal court has no jurisdiction in the matter.”

I would say your are correct. What bothers me, is in this sort of an appeals process, they skipped over the state level, which means they have to cite a federal law to make a case.

I’m curious, which one?

I’m a Pennsylvania resident and taxpayer and I object to outsiders coming in to cause havoc with our legitimate and fair election system in the Commenwealth of PA. Charge her and Hillary and the DNC under the RICO statutes.
