Trump Slams Courts By Reading Federal Law on Illegal Aliens

Speaking to a conference crowd of local law enforcement officers and leaders in Washington Wednesday, President Trump slammed the courts for what he perceives as lawyering of straight forward immigration law the White House is using to justify his recent travel ban.

Standing at the lectern, Trump read aloud title eight, chapter 12 of U.S. Code which states: "Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or non-immigrants, or impose on entry of aliens any restrictions may deem to be appropriate."

Kabar, I'm a bit surprised at your remark. "He should do what he wants"? Really? Trump is simply following a law that was created by Congress under their duly mandated constitutional authority. As such, he's merely following his legally established executive duties & responsibilities.

The entire issue is ridiculous, but the courts have become politicized. There should be no question that the conduct of foreign policy and immigration are under the purview of the President as authorized under the Constitution. However, Trump defying a federal court order would cause a firestorm and feed into the narrative that Trump is the new Hitler.

It appears to be dawning on some people (Ingraham, et al) that the judiciary has absolutely no role in the matter of border control, armed force & national security whatsoever: neither constitutionally nor as an enabling act of Congress.

Without question.

The real issue is one of an emerging constitutional crisis that is wholly of the court's making. Granting scant legitimacy by entertaining both hearings & proceedings is in effect an attempt at usurping power from the true civil authorities.

Agree completely.

Since the courts don't have any political ability to change the final outcome, these subsidiary games are actually an attempt to de-legitimize the government. Since it's being done in concert, it can rightly be construed as nothing more than seditious conspiracy.

I disagree with you on the remedy.

One should hope that the judiciary is aware of the dangerous areas they are treading.

This has gone of for far too long. The courts have usurped the legislative function and disregard the will of the people. The Dems have used the courts to implement an agenda rejected by the people. Congress needs to rein in the courts, but that won't happen as long as the Dems see the courts as an ally. They have stacked the deck.

It isn’t a matter of ignoring the courts, or the law. As Trump stated, he has every right to do his job as it is written. If you are going to let any fed judge in the country parse words, then the President may as well be the f’n Queen of England.

A “thanks but not thanks” would have been fine, and a second attempt should have been threatened with imprisonment for sedition. Remember, the “left hates us”....if we cannot get that through our thick skulls, we’re done for.

That’s what they want. He is using the “bully pulpit.” He doesn’t have a lot of options that aren’t severe.

Trump blinked when he complied federally with the ruling of a federal judge in Seattle. Perhaps you’ve been asleep?

He should have said “F U” and told federal employees that anyone that didn’t comply with his order would be fired.

That would have made a ruckus for one or two days. Instead, we’ve allowed the left to crack the door open to Liberal rule of our country by the use of Federal judges and the 9th.

I have yet to see or hear anything that suggests that I AM missing something. I wish that wasn’t the case...

I am so conditioned to Republicans laying down and exposing their cowardly bellies that this FIGHTING BACK by Trump is rather refreshing.

The Trump 'punch backs' are now contagious on the right. I see Sean Spicer, Kellyanne Conway, Mike Pence and even Mitch McConnell at times striking back FOR A CHANGE.

I hope to heaven that you are wrong, but my gut tells me you may be right. What can we do to fight back? Can we avoid the courts? If the Rats have Trump tied up in court, couldn't the congress still make law?

If what you say is true, would this begin the another Civil war? I wouldn't stand for it.

You are right on the money. Trump has setup these buffoon judges. This will go to SCOTUS, and the SCOTUS will bury it in a “New York Minute”!!! Low life Democrats, their “retard’ media and their idiot judges keep self inflicting, wounds on themselves as they destroy their own political party.

I tend to agree that Trump should've never yielded to the courts on this one. The Constitutional law could not be more clear here. If the courts can breach a clearly stated law, then everything else is subject to court action.

BTW, IMPRISON SOROS AND SEIZE HIS ASSETS and much of this resistance by the left subsides dramatically.

I'm not seeing the blinking either - I just watched his statement. I think he is playing it just if there is such a thing.

Making unnecessary enemies in the judiciary by ignoring them when he can use this opportunity to bring them to heel seems foolish.

Today President Trump literally read them the law as the Democrats are reading us the riot act. Who is looking reckless and stupid - the judges or President Trump?

I think President Trump himself said he was surprised with the decision and appeal processing time as the law is so clear but now a huge amount of the population knows this.

Trump has now framed the argument - The president is for following the law and protecting the citizens if the ninth circuit finds against him he will have gained some time to get Gorsuch. In the court of public opinion he wins and casts these judges in a very negative light - this is huge opportunity as well.

If it happens i hope he gets congress to judicial strip the ninth in to oblivion - that would be quite an example.

And oh by the way about 20 minutes into that speech today he tells the cops to call general Kelly to report on the bad hombres in the community and they are coming to round them up. It seems like he is winning

Thank you for your reasoned reply. I've always enjoyed having sensible discussions with you.

As you say, this issue has already gone on for far too long. The initial petition should have been summarily dismissed with prejudice. But now that it's become a political question, there's no walking it back. In that regard, it's already too late to avoid what you phrased as:

Trump defying a federal court order would cause a firestorm and feed into the narrative that Trump is the new Hitler.

It is what it is - the cards have been dealt and now it's time to play the hand out to resolution. Let me recap a snippet from Lincoln's 2nd inaugural address:

Trump aka We the People is/are not backing down. This is actually the opening salvo of CWII; let us hope it remains cold.

You raise some interesting points there. Everyone is assuming that this would end up being a 4-4 decision if it goes to the Supreme Court, but I'm not so sure about that. There have been quite a few unanimous and near-unanimous decisions from the Supreme Court in recent years, though they rarely got much attention.

As I remember them, it seemed like many of them were decisions about the legal authority of the Federal government (or one of its branches) in a specific matter.

The biggest legal repudiation of the Obama administration came in the infamous National Labor Relations Board case a couple of years ago. Obama was smacked down by the Supreme Court in a 9-0 decision.

Lol. The judges don’t stand a chance. They can strike down this EO and Trump will double down issuing modified EO’s. The court will be trapped by its own rulings. They are falling into a trap.
