Federal appeals court maintains suspension of Trump’s immigration order

A federal appeals court has maintained the freeze on President Trump’s controversial immigration order, meaning previously barred refugees and citizens from seven Muslim-majority countries can continue entering the U.S.

A panel with the U.S. Court of Appeals for the 9th Circuit upheld the ruling of U.S. District Judge James Robart, who had decided Friday that Trump’s temporary travel ban should be put on hold. The Department of Homeland Security soon suspended all enforcement of Trump’s controversial directive.

The Justice Department, representing the Trump administration, could now ask the Supreme Court — which often defers to the president on matters of immigration and national security — to intervene. The Supreme Court, though, remains one justice short, and many see it as ideologically split 4-4. A tie would keep in place whatever the appeals court decides.

What exactly does that mean? Judges serve for life, or until they retire. The solution is that when these sacks of crap retire or die, they are replaced by judges who recognize the rule of law. You don't just go and "break up" a federal court.

Bingo. I’ve been saying this all along. If we’re going to be thrust into a Constitutional crisis, Trump should make the most of it. Enforce his EO and defy Congress to dare impeach him - that will trigger a ginormous civics lesson on separation of limited powers.

If 4-4 ia the case with the SCOTUS, one solution would be a lawsuit on the Consitutionality on the 1952 Immigration Act that started this. If courts find it’s unconstitutional, every Presidential pardon could be revoked - as well as any standing EOs from former Presidents.

Constitutional crisis has arrived. We should make the most of it.

Thomas Jefferson warned of judicial tyranny, which we have been living under. For example, a federal judge recently ordered this to a civil litigant before illegally confiscating his property:

“You are a fool, a fool, a fool, a fool to screw with a federal judge, and if you don’t understand that, I can make you understand it … I have the full force of the Navy, Army, Marines and Navy behind me,”

No, then all hell would break loose. The media would be running stories on front pages and on TV 24/7 calling him a rogue president who should be impeached. It would be a disaster. Optics are important.

However, I do agree with you, but as a nation, we are not yet there. It would do more harm than good.

He MUST push back on this flagrant abuse of power, or he'll be surrendering the executive branch to the activist left. In short - it's a coup by the courts. The President has to assert his legal authority to do his job, and NOW.

His Presidency is at stake as is the Republic. I am not impressed with their reaction to this ruling, that surely did not come as a surprise.

Who is he listening too that has him knuckle under to a lousy district judge?

By ceding jurisdiction to the renegade courts, Trump has shown himself to be a typical GOP bigwig. He should have simply told the judge in Seattle that he had no jurisdiction in the case and told him to pound sand. I see this as a crippling blow to the Trump presidency as virtually every aspect of his beneficial agenda will be challenged in court and he will have to wait it out. Lawfare is a real concept for a reason, and Trump blew it.

So much for 4D chess.

Sad.

This is coup and should not stand. Trump should not be saying “SEE YOU IN COURT”
He should issue another EO as others suggested.

Effectively, Trump is now a neutered President. Every decision can now be taken to the same judge and overturned. The Democrats will force Trump to disobey the courts, and when he does...wham impeachment. The Republicans will never do it, their necks are on the line too. But this chaos and destruction creates gridlock and Trump’s entire Presidency is based on turning Washington on it’s head and getting stuff done. He won’t be able to if all that’s happening is fighting rear guard actions.

Just wait...the left takes to the streets in violence as this all plays out.

Or Pres. Trump did in a way no POTUS has ever walked into a trap...very dark times, Trump can and will be controlled by Courts for anything he does from here on now....Panic Mode Post(hopefully just a panic reaction)
