I’m with Judge Napolitano, Trump needs to go straight to the Supremes. The Seattle judge’s ruling is so unconstitutional thasthast Trump should be able to wring a 5-3 decision and then he can keep the ban on indefinitely.

Someone on network radio news just said that the fact that the judges took three days to issue their ruling shows that they considered the constitution.

I thought...duh...the left can come up with the lamest of excuses, then have them repeated them so often that many people think that a complete lie is the truth.

Twitter just speeds up the lie-spreading process. It used to take weeks via newspaper, then days via internet, now minutes via twitter.

Game, set, match. The law is so plain here. Anyone who can read can understand the statute. There is no room for interpretation. The ninth circuit court has signed the death wish for activist judiciary. And they didn’t realize it! No more rulings based on ‘feelings’.

Michelle Malkin is appalled but not surprised by the 9th U.S. Circuit Court of Appeals decision to uphold the block on President Donald Trump’s travel ban.

On “Hannity” tonight, Malkin said it’s outrageous that three federal appeals judges on the most liberal court in America could trump the president’s fundamental duty to protect America.

“It just shows you that judicial tyranny has run amok,” she said. “These men and women in black robes ... need to be reined in. The American people no longer have a voice in immigration.”

When the ninth Circus declared California’s Prop 187 to be unconstitutional, that was the beginning legal tyranny to destroy America by allowing illegals to pour into California and begin to destroy this state.

If this court ruling is allowed to stand, you can kiss the rest of America goodbye.

Not only the activist judges, but almost all of the Rats who support unvetted moslems entering the country.

The Rats are too dim to realize that Trump has maneuvered them into the same boat with the moslem terrorists.

Yeah, but the perogative of the President to deny immigration is also in black and white. That reality was just denied, so I expect that the left would file a lawsuit to stop such impeachments.

Hell, I expect that after an impeachment, the 9th circuit would still meet and issue rulings, paid by the state of California.

This may be off-topic, and it probably deserves a thread of its own, but I cannot justify such a vanity based on my foggy recollections and questions. If someone has more concrete information, perhaps such a thread should be started.

I read on FR that the DOJ lawyer who defended this case before the 9th circuit was assigned that task at the last minute. Two other DOJ attorneys were supposed to carry the weight, but they were somehow not available, were unwilling, or were reassigned at the last minute - supposedly the morning before the afternoon arguments.

President Trump and AG Sessions need to root out the full sequence of events that occurred at DOJ, with malice toward whoever caused an unprepared attorney to stand before the court as a sacrificial lamb. If the presenting attorney was in on it, then (IMO) he deserves disbarment and summary firing. If the two attorneys who were supposed to argue the case forced the change without just cause (under a VERY strict interpretation of "just"), they should suffer the same fate.

If it was someone higher up in the food chain, they should be prosecuted for dereliction of duty.

We are now in a constitutional crisis due to the intransigence of the judiciary. We are also in an executive crisis because the DOJ (among other departments) appears to believe they no longer have to carry out the lawful orders of the President. This, to me, is insurrection. At the very least it is dereliction of duty.

President Trump is a threat to the establishment - GOPe, Democrat, and bureaucracy. He is that threat at our specific request - his voters and supporters. DOJ, the judiciary, the state department - they have all declared war on we, the people. And they have drawn first blood in attacking our duly elected President in the lawful discharge of his duties.

I think it was an NBC affiliate. I listen to three different local stations, usually for very short periods, especially when the news comes on. They all utilize MSM feeds for their hourly national news segments, even when the show has a conservative talk show host.

Whoever wrote that bit probably thought that it wasn't true, but the impossibility of actually knowing what the three judges considered during their deliberations would not stop the dishonest MSM from making an opinion sound like a fact. They do it all the time.

Jim Noble was laying out the thoughts and feelings of the liberal elite in their own language. Those terms are accurate summations of how they feel about Trump.

It was not his own opinion, I thought that his phrasing made that fairly clear.

Don’t forget, the President gets a security briefing that non-FISA courts are not privy to, and provides the sweeping justificaton for the President to regulate immigration classes accordingly.

This would be the ground for impeachment, not the decision. Judicial immunity allows a judge to order the bailiff to kill someone in the courtroom, and if it is part of a rendered decision, total immunity as a result of judge’s ruling results.

You need to continue that thinking.

Trump knows exactly what you describe. And he’s playing a low-key game to goad them into getting the case to SCOTUS. Yes there are some lefties there but there are serious justices like Thomas who will take them behind the woodshed for a beating if they don’t take the plain letter of the law seriously. Once he gets a solid Supreme Court ruling, he can move to have the offending lower judges removed.

And the Left at large doesn’t even realize this case so far has only addressed the issue of a brief stay.

The opening statement by the Administration in arguing this case should include a reading of the specific law, plus citations (from most recent to least recent) of each case in which a President invoked its authority.

That would get it on the record, and the judges decisions would have to consider it.

I’ve worked for lawyers most of my adult life. It is amazing how many judges (so-called judges) readily overlook laws that they don’t like or that would lead to a different outcome. I’m glad they are facing the scrutiny as a class that they now are.
