DACA is not a law.
DACA is not even an Executive Order.
DACA is simply a ‘memo’ the Dept. of Homeland Security put out under the Obama administration which basically amounts to, “We’re going to ignore the law when it comes to these certain people.”
If Congress doesn’t like an existing law they should vote to change it. That’s their job!
Of course, that would mean each member actually having to answer for a decision.
Apparently, somebody much wiser than all of us has decided to intervene against public opinion.
The Constitutional failings of the DACA “policy” were fully exposed in the 5th Circuit Court of Appeals opinion of U. S. v. Texas, which upheld an injunction staying the companion DAPA policy. The 0bama regime tried to paint this as use of “prosecutorial discretion” on who to prosecute/deport, and who not to. This discretion has been granted to the Executive by 8 U.S.C. 1252. However, prosecutorial discretion is to be exercised on a case-by-case basis. It does not authorize the Executive to create a new classification of alien, which DACA/DAPA did.
As a side note on the DAPA policy, one of the key findings of the District Court that allowed it to find that it was not prosecutorial discretion but instead the creation of a new classification was that there was not one single instance of the government denying a DAPA request to any applicant who met the minimal criteria. Thus, it was not case-by-case, but blanket policy.
If you recall, Judge Hanen of the District Court had issues with the DOJ about them lying to the Court regarding the continuation of the DAPA policy after he’d ordered it halted. Judge Hanen ordered all of the US Attorneys to undergo ethics training as a result. What the criminal 0bama regime DOJ was doing was allowing Homeland Security to try to make its case when it came up for trial. Since the Judge found there had been no denials of DAPA applicants, the DOJ was going to continue to process more DAPA applications and randomly deny a few token ones to say they were exercising case-by-case prosecutorial discretion if the case were tried on the merits. Fortunately, Donald Trump was elected President and we never got to that point. The policy was scrapped and the case mooted.
