DOJ demands custody of Steinle killer

The Trump administration moved Friday to claim custody of the illegal immigrant who killed Kate Steinle, saying he violated the terms of his probation and should be sent back to federal prison.

The move is aimed at taking Jose Inez Garcia Zarate away from California officials, after a jury in that state acquitted him Thursday of murder and manslaughter charges stemming from the Steinle killing.

A Justice Department official said there’s an existing federal detainer requiring Garcia Zarate to be remanded to U.S. Marshals and sent to a federal court in Texas to answer for the probation violation.

Garcia Zarate was convicted of a weapons charge but acquitted of murder, manslaughter and assault with a deadly weapon charges from the 2015 killing of Steinle, a 32-year-old who was shot while walking the San Francisco waterfront with her father.

Start w gov brown and arrest them going down the food chain for aiding and abetting, accessories after the fact, Collusion to avoid justice, President Trump could nationalize the national guard and deploy the reserves to keep the peace in the Sanctuary city under martial law while the US Marshals raid and arrest the suspects. Could be interesting.

I wonder how the jury was instructed. Its possible that the instructions given would have precluded the manslaughter charge.

How long is someone supposed to go to prison after they cross the border a second time and that becomes a felony?

Also, does anyone know why, if this gun was so prone to going off by itself (yeah, right), the Bureau of Land Mismanagement ranger continued to carry it? (And left it in his car in the middle of a city?)

She was hit with a ricochet. There was no way to get him for first degree, probably not second degree. Intent was not to kill her. But firing a gun, on a crowded tourist pier??? Ridiculous he didn’t get some manslaughter conviction. Acquittal is jury nullification and unconstitutional.

The pistol he fired requires a 10 lb trigger pull to fire the first shot. No one does that “accidentally” - although in SF, no one on the jury may have ever touched a gun before.

In liberal theology, guns simply "go off" by themselves all the time. It's reasonable to assume a San Francisco jury would lack the knowledge to understand what you just explained, without detailed instruction from one of San Francisco's Kamala Harris-like prosecutors, who wouldn't know either.

It would be good for Kate’s family and friends to have an hour to discuss the matter with the killer, in person, with no legal repercussions for any direction they may decide to take that conversation in.

Have to disagree here. The People are the *final* arbiters of what IS Law. May not like the outcome, but they had EVERY right to do what they did.

Just hope there’s another 12 w/ the same mindset when your ox is getting the govt treatment...

Now, the aiding and abetting of govt? That should be where Fed starts moving in & frog marching. Once they see they mean biz., Brown’s pawns will start towing the line.
