Will I be bust by DEA or whoever if I buy a Poppy from that 70+yo lady that is front of the our Post Office each Memorial Day weekend? Hmmm, maybe if it was a really ripe one. They are the same plant...

Ornamental Poppies (Papaver orientale) are the same species as the Opium Poppy (Papaver somniferum) but they are different cultivars. Ornamental Poppies have no narcotic alkaloids in them.

The Memorial Day poppy is supposed to be a Flanders Poppy, Papaver Rhoeas. The opium poppy is Papaver somniferum. The plants are similar, but the Flanders Poppy isn’t a controlled substance.
And, even though Opium Poppies are illegal, you can still find seeds for them at most garden centers. They’re a popular ornamental.

The latex that many plants produce upon injury is a defense mechanism designed to kill. Latex rubber is designed to gum up the mouth parts of insects. The opium latex is meant to kill in other ways, and it does.
