Like the ACLU famously did in its legal defense of neo-Nazis who wanted to march in a Jewish-majority Chicago suburb 40 years ago, Sen. Ted Cruz, R-Texas, on Wednesday in a hearing defended the First Amendment right of a man to invoke a Nazi salute to express his view that school board members were acting like fascists.

In fact, in the Senate oversight hearing, Attorney General Merrick Garland agreed with Cruz that the man's action was constitutionally protected.

Nevertheless, the Daily Beast was among many left-wing outlets that framed the exchange as "Ted Cruz Defends Parents Doing Nazi Salutes at School Board Meetings."

Democratic Reps. Eric Swalwell of California and Ilhan Omar of Minnesota joined in the smear.

I knew this would come back around almost as soon as I heard Senator Cruz make the point.

The issue was settled long ago by the ACLU. Back then, the whole "what good is free speech if it doesn't apply to speech that's unpopular or even offensive" became familiar to everyone who was paying attention.

Neither Ilhan Omar or Eric Swalwell were even born when this issue was fought over, back during the Carter administration. It even made its way into the movie The Blues Brothers, which originated at The National Lampoon in 1978, the same year the Skokie case was a national story.

I feel confident that Senator Cruz anticipated this reaction and is ready for it.

3. The ACLU attorney for the Nazi lawsuit about their right to March thru Skokie (the home to many Holocaust survivors) was Steve Levinson. He was my teacher at the paralegal institute I attended.

A real gentleman, very good attorney and strong defender of First Amendment rights for all people, no matter how despicable some of them could be.

My understanding is that the parent made a mock-Nazi salute. He was protesting the authoritarianism of the school board, saying they were acting like Nazis. The left is trying to turn this upside down and make it sound like the parent is a neo-Nazi and was making the Hitler salute as an expression of supporting Naziism and racism. And by extension smear anyone who is opposed to CRT as a Nazi. The media will carry this narrative. The low-information voters will eat this up and think the Republicans are sending Nazis to attack schools.

Constitutionally protected speech pointing out that the school board are acting just as fascists’ do, done, did, are. So a comparison is something that true fascists hate. Garland, however, is the real authoritarian fascist.

Conservatives dodged the proverbial bullet with the weaponization of the Federal law enforcement and FBI.... The DNC shot it’s wad and missed. Now that measures to prevent further damage by the FBI and DOJ are happening, the DNC will have to recalibrate their assault on the Fourth Amendment and the right to gun ownership.
