Trump Must Pay Half a Billion Dollars Before He Can Appeal New York Decision

Former President Donald Trump must pay nearly half a billion dollars as a bond to New York State before he can appeal the ruling by Judge Arthur Engoron last week that he must pay $354 million in fines — over $450 million, with interest — for fraud.

Critics have noted that Trump is the only person ever to be sued under an obscure New York fraud statute that does not require any harm be done, and that effectively criminalizes the everyday practice of real estate valuations in negotiations with banks.

Though Attorney General Letitia James — who ran for office promising to target Trump — claimed that no one is above the law, her case against Trump marks the only such case in the history of the state. And the staggering fine is likewise unprecedented.

If Trump was guilty of the alleged fraud he would presumably have no money to pay, and if he was not guilty, he would have the money to pay but no reason to be found guilty.

I don’t think that is correct. A judge has no authority to make that rule.

The US Supreme Court RARELY intervenes in a state court civil action, and they have been consistently ducking making any big decisions. Plus, Trump will need to post the full award + interest to stay enforcement during appeals. This is really bad and not sure what the solution is. Even the wealthiest of people don’t have $400M in cash laying around.

Well, if the SCOTUS ducks this one, New York could be a
financial ghost town. Those dealing in loans of this
nature see a real risk down the road. That’s why James
addressed it yesterday. “No, we won’t do the same to
you. Trump is just someone we don’t like.”

Not that exact wording of course, but that’s what it
boiled down to.

This stands a very good chance of blowing up in their
faces one way or another.

Thanks for your comments. I don’t have any reason to
disagree with them, but I do hope Trump is made whole
on this.

No, nobody keeps half a billion dollars laying around
not earning them income. Trump will have to liquidate
properties, and having to do that over a case like
this is unacceptable to a lot of people.

Analogous to a person convicted and sentenced to death and the execution must be carried out before the convicted person can appeal the conviction or the sentence. Calling this entire lynching of president Trump and his family Outrageous is an understatement!

100% wrong. No federal court has standing to take on the matter until all state level appeals have been unsuccessfully exhausted.

Trump should be able to appeal this to federal court, on the basis that it is a complete violation of the Eighth Amendment prohibition on excessive fines and penalties. Additionally, since he is the only person who has ever been prosecuted under this obscure statute, he can argue that it is a violation of his fourth amendment to process rights, that this prosecution - especially in light of Leticia James promising to “get Trump” during her campaign - is arbitrary and capricious. He doesn’t have to post bond in order to challenge this abomination federal court. The only question I have is whether he has to exhaust all of his state level appeals before going to the federal level.
