Ruling Upholds Firing on Basis of Religion

SAN FRANCISCO -- Religious institutions cannot be held liable for discriminating against employees on the basis of religion, the California Supreme Court ruled unanimously Thursday.

The state high court threw out a lawsuit by an evangelical Christian who was fired from a Catholic medical foundation after he proselytized to other employees.

I don't get it? He worked for a religious company..... he was religious, and was fired for being religious at his religious work place? what did I miss?

Steven Drapkin, who represented a religious freedom organization in the case, said the decision shows that the court realizes that the "breadth of a religious organization's mission is not limited to houses of worship."

Let's hope they realize this in a non-selective manner.

Preaching to the choir is wrong if you are not a member of that church. You could even get fired if you are an employee. Hmm. Seems reasonable.

What you missed is that he is from a more fundie cult than Catholism,and he was getting in their faces and telling them they were going to hell unless they converted to HIS cult. You have no idea how obnoxious these SOB's can be untill you have to deal with one yourself. Politely telling them you don't share their beliefs and asking them to leave you alone doesn't work. Neither does being rude and telling them to shut the hell up. Your only real option is to resort to violence,or the sincere threat of violence.

This has more to do with capitalism than religion. One should be free to engage in commerce with whomever one chooses.

Unfortunately, if this lowlife was gay, he'd have won. I'll take any victory, however...

You missed the fact that a religious organization does not have to provide a forum for a supporter of another religion to proselytize in. Would you be so confounded by this decision if that person was a proselytizing satanist or a wiccan? Or do you believe that all religious organizations should be forcibly opened to recruitment, by the courts, to any group regardless of their religious tenets? If so say good-by to freedom of religion.

Simply hoping that if/when a Muslim employee is fired from a private Catholic organization under similar circumstances, the court will have the same opinion as below.

Secular employers can still be held liable for religious discrimination, but religions need "considerable discretion to choose employees who will not interfere with their religious mission," Justice Carlos R. Moreno wrote for the court.

Sneakpete is not a disruptor. You've been here a month. You'll find that not everyone on FR is religious, and of those that all, not all are Christian.

Most employers have a strict 'no solicitation' policy. You don't go trying to sell another product (in this case, a denomination) to customers of your business.
