American Voters Overwhelmingly Agree with Justice Department: Individuals Have Right to Bear Arms

A wide majority of American voters (75%) agree with the Justice Department’s position that the Second Amendment guarantees the right of individuals to keep and bear arms. Just over a fifth (22%) disagree with the Justice Department, while 4% are unsure.

This result follows a Supreme Court brief filed in early May in which the Justice Department stated its interpretation of the Second Amendment that individuals have the right to bear arms. Since 1973, the department has argued that the Second Amendment protects only gun ownership by state militias, not individuals.

Zogby International interviewed 1,015 likely voters chosen at random nationwide on behalf of the Second Amendment Foundation, an educational and legal defense organization that works to protect the civil rights of firearms owners. All calls were made from Zogby International headquarters in Utica, New York, from Tuesday, May 28 to Thursday, May 30, 2002. The survey has a margin of sampling error of +/- 3.2%.

Republicans (84%) were most likely to agree with the Justice Department’s position. Residents of the South and the Central/ Great Lakes, and West (79% average) as well as respondents 18-24 years old (82%) were also more likely to agree. Majorities of Democrats (65%), Easterners (60%), respondents earning $75,000+ annually (70%) and those 65 years or older (65%) also agreed with the Justice Department.

“Even among Democrats, senior citizens and the middle class, large majorities do not accept the so-called ‘collective right’ theory promoted by the most ardent gun grabbers,” says Alan Gottlieb, founderof the Second Amendment Foundation. “This poll indicates that anti-gunners are not even in-step with their traditional core groups.”

Say, last Saturday (6/1/02) I had a letter to the editor published in the "Sacramento Bee". I was pissed cuz they trashed John Ashcroft on the 2nd amendment. Here's my short letter:

"So, The Bee likens Ashcroft to a 'Middle Eastern ayatollah issuing a fatwa'. Seems The Bee just can't get enough of trashing our country's attorney general.

This particular editorial criticized Ashcroft for his department's stand on the gun issue; namely, that gun ownership is an individual's right as opposed to the rights of militias.

I for one am grateful for Ashcroft's position on the gun issue. It's about my Second Amendment right to defend myself and my family - especially in light of Sept. 11.

If The Bee can put me in touch with a Sacramento-based, armed citizens militia group, maybe I'll change my tune. Otherwise, get off Ashcroft's case and stop trying to take away our guns."

The Constitution gives no rights, it only guarantees from oppression, the rights that you and I were born with. As for the militia, my friend, "WE THE PEOPLE" are the militia.

Correct me if I'm wrong, but I thought the purpose of the 2nd amendment was to allow citizens to protect themselves against a government gone awry. So, what good is a squirrel rifle against the US military machine? Or against a SWAT team?

AR-15's, Uzi's, H&K's, and many of the Chineese "assault" type weapons are perfectly legal in this country although not as inexpensive as your squirrel gun. There are tens of thousands of these weapons in the US.

While I'm NOT advocating any action, use of these weapons against our own government in an urban situation would be difficult to control. Its doubtful that any administration would want to leash helicoptor gunships or jets on urban areas that may or may not contain hostiles. Remember how much grief, the city of Philadelphia got for years over burning out a city block in an attack on some extremists.

Depends on what you use to shoot squirrels. From what I've seen in documentaries about SWAT teams, it looks like one person with sound tactics and a battle rifle (something like an M1, an M14 or various more modern "black" rifiles in .308 or so)could hurt a SWAT team. Several people with lessor weapons, very good marksmanship and again, sound tactics might do the same.

As to the military machine, physical or metaphorical, a rifle might not hurt the hardware, but it will hurt the internal guidance system (if you can get to it).

I have found that those ages - and younger - are well aware of the dangers they face, and understand the need for being able to defend themselves. Especially the women/girls. They are being bombarded with "passive resistance" b.s. and "no one should have guns" constantly, and are resisting because they do have some experience with violence and some common sense. We MUST keep up and increase our efforts to defeat the MMMorons and their ilk, and train our young ones in firearms, avoidance, and their rights under the Constitution.

Of course, I expect that *some* of it might be due to the fact that kids will do almost anything to NOT be like their parents, so the MMMorons have smart kids who will get training and firearms as soon as it's possible. ;o)

You know, I don't think that "most" Americans actually DO want more gun control laws. I was called for one of the surveys, and they actually hung up on me. I was ranting at them because their questions were misleading and ridiculous. Whenever you hear that "polls say that ..." you should try to find out what questions were actually asked.

I have, for instance, been trying for months now to get the wording of polls touted by the Ceasefire NH talking head, and he has quit even trying to deflect me, and is now ignoring me. Ha! It's kind of cool ... this is playing out in the Community Comments in our local papers, by the way.

I don't know ... you might want to rethink what good a country full of determined citizens can do with squirrel rifles against a government. Many times, governments have underestimated that kind of resistance and lost. It's the main reason why they start out any movement to oppressive government by disarming the populace.

I always ask the few democrats I find that believe the 2nd is not a individual right how they can say it's a collective right when the 1st, 3rd, 4th etc are not.

I've yet to find one who can justify it, if they even understand what I am talking about.

I attended CalAPRA (Calif American Pistol & Rifle Assn) meeting this past Monday night at McClellan AFB and I was kind of disturbed to find that several of the speakers got way off subject - conspiracy theories, trashing President Bush, etc. They even trashed other attendees for not being anti-government enough. One of the speakers said that Congressman MacDonald (whose plane went down many years back out of Alaska) - she said that MacDonald is still alive and being held captive in Russia. I don't know. Maybe I'm crazy but I don't understand why they're discussing all these conspiracy theories at a pro gun event. Do you? For victory & freedom!!!
