I agree with everything you said. Rudy in '04, Pataki in '06, and all of a sudden the two Senators from NY will be Republicans. Of course, we have to convince Rudy (i) to run and (ii) to back the ban on partial-birth abortion so that the Conservative Party will endorse him instead of endorsing someone else.

What if the D's aren't there in the senate? Can a number of senators less than 60 vote to end the fillibuster?

I dunno, and bear in mind I'm certainly not an expert on NY politics...but I heard that if Lazio had made more of a play for upstate, he'd have made it a close race. I have to think that Pataki isn't that dumb. GOPers all over -should- turn out in NYS to elect him over Shrillary. He'd certainly be the most formidable opponent to take her on. IMO. Assuming Rudy does go after Chucky's seat and I think the Rove crew is pressuring him to do just that.

How can a filibuster be stopped?

A filibuster can be stopped when the Senate invokes cloture. This can be an arduous task in and of itself. To invoke cloture, a Senator needs to do the following:

1. Wait two days after a filibuster begins.

2. Obtain sixteen signatures on a motion to invoke cloture.

3. Wait another two days before the Senate can vote on cloture.

4. Make sure that three-fifths of the Senate (sixty Senators) vote to end debate.

5. Endure and additional thirty hours of debate before the final roll call vote.

Domenici expressed hope that Senators "would be required to actually speak on the floor" during a fillibuster, as used to be done (a la "Mr Smith Goes to Washington"), but has been relaxed in recent years. Frist also has hinted at reestablishing this, much to the anger of Democrats. One can only hope.
