It takes 2/3 majority vote to close debate (invoke cloture), in order to force a vote.

Cloture used to require 2/3, but now you just need 60 senators to vote for it.

I certainly hope so - no more funny business for the Senate, just getting the job done and getting the country moving - protecting the homeland, and getting all the necessary equipment to our military.

VERY excellent point by Orrin. The Constitution gives the President the power to nominate, the Senate the power to advise and consent. There is no power vested in 41 Senators to block an appointment; that requires 51 votes. It is not like a typical vote on legislation. Here's the way to test it: Call the senate in Session, hold the vote over the objection of the Dims, get him 51 votes, then let the Dims go to court to block the nomination on the grounds that there was no successful cloture vote. The court will throw that one out as being a matter for the Senate to decide internally; it won't get involved. If the courts did get involved, they would probably find that the "advice and consent" clause requires only a majority vote, and says nothing about the procedure to get there.

Meanwhile, Miguel goes to his seat and starts judging.

Looks like a fine, fine strategem, to me. I suppose that staff and Senators are discussing this. That doesn't mean that writing to the GOP Senators about it wouldn't do some good.

Dear Senator Frist

Regarding the nomination of Miguel Estrada. It appears the democrats are holding up this nomination by refusing to allow a vote. 60 votes being needed to close off discussion. I hope the Republican leadership and fair minded democrats will call for an up or down vote by the full senate on this nomination or force those discenting to engage in a 24/7 round the clock fillibuster.

Please let the American people see the ideologues for what they are. Partisan politicians who believe the ends justify the means.

Last night I heard the largest Hispanic organization in the country.They are very upset about the Dem's holding up his vote.

I believe they will pay BIGTIME at election time.

Watching the dems make fools of themselves on CSPAN via the internet this morning.

LOL... they sound like they are arguing with themselves at this point. But... but... but...

Who cares who Reid defended in the past.... lets get on with the vote.

Freepers, rather than waiting to see what happens with Estrada and Owen, we need to take the lead. That means presuring Senators, special interest groups, media organizations, etc. This thread is meant to be an ongoing effort to get this man confirmed. For too many years liberals have had their way on the courts. Now, President Bush is in a position to move the courts to the right. The election of '02 showed that the country is with the President. I think it's time to let Daschle, Hillary, and Pelosi know this is Bush country. Are you with me! Let's FREEP these people.
