Well, that didn’t take long. A non-White American citizen born right here in the United States has gotten a spot on the Democratic presidential ticket, and the birthers have come scurrying out from whatever rock they have been living under since Barack Obama left office. Within hours of former vice president Joe Biden’s announcement Wednesday of his history-making running mate, once-reputable Newsweek posted a story posing “Some Questions for Kamala Harris About Eligibility.” The author, John Eastman, a conservative law professor, wrote that “some” are “questioning” whether Harris might be “constitutionally ineligible” to be vice president because, should she have...

MONTGOMERY, Alabama -- The Alabama Supreme Court has upheld the dismissal of a 2012 lawsuit which wanted Alabama's Secretary of State to certify the birth certificate of each presidential candidate before allowing their names to appear on the general election ballot. The court ruled 7-2 on the issue, with Chief Justice Roy Moore one of two justices who dissented from the majority's decision, arguing the lower court should have directed the secretary of state to check candidate birth certificates.

The new birthers: Debunking the Hillary Clinton health conspiracy (CNN LOL alert)

From Donald Trump and his top surrogates to the right-wing media and its engine rooms of outrage in the blogosphere, Hillary Clinton's opponents are ramping up efforts to sow doubt over the candidate's health. The campaign -- which goes back years -- has escalated to shouting over the summer, as Trump spiraled in the polls while mostly failing to connect with voters outside his base demographic. Now, as the race enters a crucial phase, there has been a growing push to fundamentally undermine Clinton's candidacy. Much in the way "birthers" (Trump was among the most prominent) sought similar ends by...

FoxNews Joins the Cavalcade of Idiot Ted Cruz Birthers

Any political issue is exactly as serious as the media decides to treat it. There have been a lot of changes in the influence of the media over the last 30 years, but that is still more or less the truth - even the stories that were pushed by blogs and alternative media only became stories when the media were effectively shamed into covering them. Questions about Obama's eligibility for President were not a serious news story because the media made the a priori decision to make fun of anyone who raised them. As we noted this morning, look at...

Why Ted Cruz ‘birthers’ are not the same as Obama birthers

Questions about Cruz's eligibility have everything to do with interpretation of the law; the questions about Obama's eligibility had everything to do with a dispute over the underlying facts - more specifically, conspiracy theories about whether the president was born in the United States, as he claimed, and whether he somehow forged a birth certificate that said he was born in Hawaii. In Cruz's case, nobody is disputing the underlying facts of the case - that Cruz was born in Canada to a Cuban father and a mother who was a U.S. citizen. As we wrote in March 2013, that...

Donald Trump: Spokesman for birthers, truthers, and Internet trolls

... Watching Donald Trump bluster and bluff his way through a presidential campaign, I wonder if we underestimate the ways in which Internet vitriol has broadened the parameters of political debate. We are "shocked, shocked" by Trump's language, but all of it is exactly the sort of thing anyone can encounter in the normal course of reading about politics online. John McCain isn't a war hero? I'll bet he finds worse insults than that on his Facebook page, and so does everybody who writes about him. All Mexicans are rapists? I open my Twitter account every morning to find similar...

On Citizenship, the ‘Birthers’ Are Right: Constitution, Tradition, favor Birthright Citizenship

Donald Trump stoked the immigration fires that are burning up the Republican party by proposing an end to birthright citizenship. This week he claimed that children of aliens who are born on U.S. territory “do not have American citizenship” and that their right is “not going to hold up in court.” Trump’s argument runs headlong into the Constitution. His proposal shows, once again, that while he may be running as a Republican, he is not running as a conservative. Conservatives believe in following the Constitution’s text, as understood by those who wrote and ratified it and with due regard for...

The birther movement has come home to roost as the Republican presidential primary heats up. snip Ted Cruz snip Marco Rubio snip Bobby Jindal snip Rick Santorum In a column published last week on the conspiracy theory website WND, author Jack Cashill noted that questions had been raised about whether four of the 17 candidates in the GOP field were really "natural born citizens" and therefore eligible to run for President.

Dr. Ben Carson Defends Birthers: Why Would You Go Through Such Lengths To Hide Past!?

Al Hunt on the Story implied that Donald Trump was being a racist when he brought up Obama's records. "[Carson]I don't believe that is true that he was born somewhere else...but I can understand why someone who specifically blocks a lot of his records, would cause somebody to become suspicious... It wasn't something that came out of the blue... Why if you are running for public office and specifically running for President of the United States, why would you go to such lengths to hide important parts of your history... Having spent many years in academia, when somebody goes from...

Yes, birthers, Ted Cruz IS a natural-born citizen of the U.S.

This should not even be an issue any longer, but there are still some out there who didn't get the legal memo. First, some history: The origins of the Natural Born Citizenship Clause date back to a letter John Jay (who later authored several of the Federalist Papers and served as our first chief justice) wrote to George Washington, then president of the Constitutional Convention, on July 25, 1787. At the time, as Justice Joseph Story later explained in his influential Commentaries on the Constitution, many of the framers worried about “ambitious foreigners who might otherwise be intriguing for the...

Cue the Ted Cruz birthers… again [Once more with feeling: "Is he a natural born citizen?"]

Now that Ted Cruz is officially in the Presidential race, you may rest assured that some of the same people who considered it an insult of titanic proportions to even ask to see President Obama’s birth certificate will be kicking off a similar conversation regarding the Texas Senator. Because, you know… he’s a gosh darn foreigner. For the few of you who may have missed it, Cruz was born in Canada. His father was from Cuba but his mother was a US citizen. As our colleague Guy Benson explained over a year ago, this one isn’t even a question....
