End The Filibuster

If, while we hold the majority, do not end the filibuster now, then the Dems, were they to re-gain control, would end it immediately. We would be on the receiving end right away. There would be no more "Gentlemanly Rules of Protocol" left. So, I vote for "Advantage Us" now.

“When the people find that they can vote themselves money, that will herald the end of the republic.” This was the nightmare of Ben Franklin. Yet, with passage this spring of a $4 trillion bailout of an economy facing historic losses because of the COVID-19 pandemic, and Nancy Pelosi’s House having voted out another $3 trillion, we may have reached Franklin’s peril point. Indeed, if Democrats capture the Senate and win the White House, as many polls now project, it is not easy to see who or what prevents an uncontrolled explosion of fresh spending and a concomitant expansion of...

The Filibuster in the Era of Trump

The filibuster may seem a weapon of obstruction in the hands of Senator Schumer, but the Minority Leader may find himself in a trap of his own making when he uses it. During the Obama years, Republicans campaigned on the promise that "If we control the Senate and the House, we will pass conservative laws to rein in a lawless Obama administration." But after each election Senate Majority Leader McConnell said that that it was almost impossible to get anything done because the Democrats blocked every meaningful action in the Senate. Does that really mean that we have to elect...

The Democrats' Filibuster Con

When West Virginia's Joe Manchin closed the door on eliminating the legislative filibuster this week, promising not to "weaken or eliminate" the 60-vote threshold, he "dashed" the "dreams" of Democrats, according to The New York Times. Hypocrisy is nothing new in Washington, but it takes a preternatural shamelessness to have participated in over 300 filibusters, as Democrats did in the past few years, and then one day turn around and treat the procedure as an odious racist relic that threatens "democracy." But this is an emergency, norm-breakers will tell you. Isn't it always? Senator Jacky Rosen, after a quick reversal...

Filibuster Gorsuch, Please

Supreme Court: After Judge Neil Gorsuch spent 20 hours demonstrating that he is abundantly qualified to be a Supreme Court Justice, Democrats announced plans to filibuster his nomination. Good luck with that. By all accounts, Gorsuch put in a stellar performance in his confirmation hearing. Even the New York Times conceded that "if Democrats harbored any hope of raising doubts about Judge Gorsuch among Republicans, they came nowhere close." But as soon as the hearing ended, Senate Minority Leader Chuck Schumer announced that he was going to filibuster the nomination anyway. Gorsuch, Schumer said, "was groomed by the Federalist Society...

Manchin: Nothing new on BBB ... or the filibuster either

The latest proclamation from King Joe runs counter to the buzz promoted by the media. Supposedly, Joe Manchin had returned to negotiations on Joe Biden’s Build Back Better plan, and might even have signaled a willingness to do a nuclear-option carve-out on the filibuster for the election-federalizing SB1.Not so fast, Manchin said a few minutes ago. First, no one’s changed positions at all on BBB and there haven’t been any new talks so far:

Congress is preparing to pass an Omnibus spending bill that will fund the government through the rest of fiscal year 2017. Democrats love the bill because it fully funds Planned Parenthood and specifically omits many of President Trump's legislative priorities, such as funding for his proposed border wall with Mexico.House Minority Leader Nancy Pelosi undoubtedly spoke for most Democrats when she praised the bill on Monday:“We have eliminated more than 160 Republican poison pill riders, ranging from undermining a woman’s right to reproductive health to dismantling Dodd-Frank’s vital Wall Street consumer protections... The omnibus does not fund President Trump’s immoral...

The Case For Killing The Filibuster

Senate Democrats are using the filibuster to try and embarrass the GOP into backing down on the House's version of a funding bill for the Department of Homeland Security, a version which would roll back the president's unconstitutional unilateralism on immigration reform. Congressional Republicans are trying to put on a show of unity, but the fissures are already evident. The demands from conservative activist leadership and the grassroots' legions for Senate Majority Leader Mitch McConnell to invoke "the Reid Rule" and smash what's left of the Senate filibuster using the same procedural maneuver that Harry Reid used to kill the...

Can the Dems Bust the Filibuster?

The Senate is split 50-50 between the two parties. However, if a vote were now held to eliminate the filibuster, this split morphs to 48 yeas and 52 nays. Such a tally allows the filibuster to survive. And it allows the sometimes despised but always wily Mitch McConnell to keep foiling the radical (and rabid) Democrat agenda. Only a simple majority is needed to eliminate the filibuster, but if the filibuster is in play, sixty votes are required to pass legislation. The Democrats’ agenda includes HR-1 and HR-4, which would end legitimate elections in the United States. It includes HR-5,...

Filibuster of Veterans Bills

I am having an argument with a Lib, his stance is that the Repubs have filibustered all veterans bills in the senate, when I look at the congressional record, it seems the bill never got out of committee. However, there are a mountain of websites claiming the repubs are filibustering vets, for example: Some of the bills that they filibustered - bills that would have helped American people in this difficult economy: H.R. 12 - Paycheck Fairness Act H.R. 448 -- Elder Abuse Victims Act H.R. 466 - Wounded Veteran Job Security Act H.R. 515 - Radioactive Import Deterrence Act...

Kill the filibuster. Kill it now.Traditions are nice and institutional prerogatives can be important, but right now on Capitol Hill, the tails are wagging the dog. The filibuster is already dead – Harry Reid killed it when he chose to disregard it to pack the District of Columbia Circuit – and pretending it isn’t is not only ridiculous but it is ripping the GOP apart. It’s like a legislative Weekend at Bernie’s starring pouty Mitch McConnell and fussy little Lamar Alexander. The filibuster, a mere Senate tradition and not a constitutional mandate, is not just an obstacle to enacting our...

Why Democrats probably won’t get rid of the filibuster for abortion

Though the conservative Supreme Court appears poised to strike down Roe v. Wade, Democrats control slim majorities in both chambers of Congress, and they have a president in the White House supportive of abortion rights. They also have public opinion on their side. But one thing stops them from passing a federal law protecting abortion rights and codifying Roe into law: the filibuster. The filibuster is a Senate rule that requires 60 votes to pass most legislation. Most controversial legislation is passed on party-line votes these days, and it’s very rare for parties to have 60 senators. Democrats only have...

New presidents have only so long to get big legislative initiatives done. It's already June, and the clock is ticking for President Joe Biden. Big bills take a long time. Congress will spend much of the summer on recess. They'll be at work in the fall, but by the end of the year, Democratic and Republican lawmakers will be obsessed with winning reelection in 2022. But Biden has an even bigger problem than the calendar. In the last election, Democrats failed to win a majority in the Senate, and the body is now tied 50-50. If Republicans are united in...

In 2003, when Chuck Shumer began filibustering Bush’s nominees to the lower courts — a departure that tested what was a relatively new “norm” — the GOP came close to getting rid of it. In 2013, after the GOP had successfully filibustered 5 — yes, just 5 —

Back when I was a young staffer in the House of Representatives, we viewed the Senate with some disdain. Senators -- and more so their staffs -- were imperious. They viewed themselves as being in the higher chamber and employed arcane rules, most notoriously the filibuster, to block actions they didn't like. But I've learned a thing or two in the more than 40 years since I left my job on the House Judiciary Committee, and I've changed my mind about those Senate rules. Sometimes we need a brake, judiciously applied, to give politicians and the country the time to...
