The Minnesota Supreme Court on Wednesday reversed the third-degree murder conviction of former Minneapolis police officer Mohamed Noor, who fatally shot a 911 caller four years ago. Noor was also convicted of second-degree manslaughter in the death of Justine Ruszczyk Damond on July 15, 2017, and that verdict still stands. The former officer will be re-sentenced for the manslaughter conviction alone, as opposed to the 12 1/2-year penalty handed down to him in 2019 for murder.

The Minnesota Court of Appeals has affirmed the third-degree murder conviction of former Minneapolis Police officer Mohamed Noor. Noor was convicted of third-degree murder and second-degree manslaughter in the fatal shooting of Justine Ruszczyk Damond in 2017 while responding to Damond's 911 call about a possible sexual assault behind her south Minneapolis home. His attorneys argued that there was insufficient evidence to convict Noor of third-degree murder and the court wrongly allowed prosecutors to present two expert witnesses who provided similar testimony. The three-judge panel looked at five points in considering his appeal: Whether the evidence at the trial was...

Two days before Mohamed Noor is to be sentenced, attorneys for the former Minneapolis police officer convicted in the fatal shooting of Justine Ruszczyk Damond have asked a judge to consider an unusual sentence that would only have Noor locked up for two weeks a year. In their memorandum in support of a "mitigated sentencing departure," attorneys Thomas Plunkett and Peter Wold asked the court to consider Noor's lack of a criminal history, remorse and community support. In the first of two proposed sentences, the attorneys asked for no prison time, instead requiring Noor to turn himself in to the...

Attorneys for the former Minneapolis police officer convicted of fatally shooting an unarmed woman in 2017 plan to ask a sentencing judge for no prison time. If that’s not granted, they’re seeking less prison time than state sentencing guidelines recommend. Mohamed Noor’s lawyers filed a motion Thursday asking for a “dispositional departure” when he is sentenced June 7. He was convicted of third-degree murder and second-degree manslaughter in the fatal shooting of Justine Ruszczyk Damond, a dual citizen of the U.S. and Australia. She had called 911 to report a possible sexual assault in the alley behind her house.

Former Minneapolis cop's behavior before shooting death of Australian woman raised concerns, court filings say. (Full title). ... The former Minneapolis police officer charged in the shooting death of Justine Ruszczyk Damond once put a gun to a driver’s head during a traffic stop and sometimes ignored calls, according to court filings indicating that psychiatrists and training officers voiced concerns about his fitness for duty. The revelations surfaced after defense attorneys filed a motion Wednesday seeking to dismiss murder and manslaughter charges against Mohamed Noor, who is accused of shooting Damond in July 2017 after she dialed 911 to report...

Lawyers for the former Minneapolis police officer charged in the shooting death of Justine Damond have filed a response to the state outlining “factual misstatements and mischaracterizations.” Mohamed Noor’s attorneys dispute several items brought up in the state’s court filing last week, including a motor vehicle stop on May 18, 2017, four training days and “misleading discussion” of his psych evaluation. Noor’s lawyers want this information declared inadmissible in court and not considered for probable cause. In Wednesday’s filing, the lawyers call the state's claims “disgraceful” and “inaccurate," stating that “these lies by omission and clear misstatements of fact actively...

The Hennepin County Attorney's Office is asking a federal court judge to grant a request by attorneys for former Minneapolis police officer Mohamed Noor to have a civil case filed against Noor and others stayed until after his trial on third-degree murder and second-degree manslaughter charges has concluded. The request was filed in August in U.S. District Court. The family of Justine Damond - the Australian woman killed in the July 2017 shooting - has filed a lawsuit in federal court against Noor, partner Matthew Harrity, former police chief Janee Harteau, current police chief Medaria Arradondo and the city. Defense attorneys want charges dismissed against a former Minneapolis police officer who shot and killed an Australian woman last year. Attorneys for ex-officer Mohamed Noor argue in motions filed Wednesday that the charges should be dropped because of prosecutorial misconduct and lack of probable cause. Noor is charged with third-degree murder and second-degree manslaughter in the July 15, 2017, death of Justine Ruszczyk Damond, a 40-year-old life coach who was engaged to be married. She was killed after calling 911 to report a possible sexual assault. Prosecutors say Noor was in a squad car's passenger seat when he shot Damond...

Hennepin County Attorney Mike Freeman went back on his word and decided to use a grand jury in the officer-involved shooting death of Justine Ruszczyk Damond, 40, who was killed in an alley near her home when Minneapolis Police Officer Mohamed Noor and his partner, Officer Matthew Harrity, responded to her 911 call about a possible assault in the area. Hennepin County Attorney Mike Freeman is convening a grand jury to gather evidence in the 2017 shooting of Justine Damond, but said he still will decide whether Minneapolis police officer Mohamed Noor will face charges in her death. Matthew Harrity, Noor's partner the night Damond was killed, was served a subpoena Wednesday to testify before a grand jury, said his attorney Fred Bruno. "It came as a surprise," Bruno said. He declined to say when Harrity will testify. Hennepin County attorney's office spokesman Chuck Laszewski maintained that Freeman "will continue the office's two-year-old policy where he makes the decision on...

The father of Justine Damond said family members have concerns about the investigation into her death after Hennepin County Attorney Mike Freeman was captured on video last week criticizing investigators in the case. Freeman said he didn't have enough evidence to charge Minneapolis police officer Mohamed Noor because investigators "haven't done their job." Damond was shot in July when she approached Noor's squad car after calling 911 to report a possible sexual assault. John Ruszczyk said investigators from the Minnesota Bureau of Criminal Apprehension promised the family a thorough investigation after Damond was killed last summer. "We are apprehensive that...
