On Monday the 5th U.S. Circuit Court of Appeals denied the Navy's request to reinstate the U.S. Navy's COVID-19 vaccine requirement. In November, dozens of U.S. Navy SEALs claimed they were wrongfully denied COVID vaccination exemptions on religious grounds. The suit, which lists 35 unnamed service members, argues that that the Defense Department's mandate violates their First Amendment rights. While the percentage of vaccinated active duty personnel in each service is at 95 percent or higher, the number of unvaccinated personnel is close to 30,000. The Navy itself has previously said that it has not granted an exemption to any...

In U.S. Navy Seals 1-26 v. Biden, (5th Cir., Feb. 28, 2022), the U.S. 5th Circuit Court of Appeals refused to grant the Navy a partial stay of an injunction issued by a Texas federal district court protecting 35 special warfare personnel who object on religious grounds to complying with the military's COVID vaccine mandate. The court said in part: Defendants have not demonstrated “paramount interests” that justify vaccinating these 35 Plaintiffs against COVID-19 in violation of their religious beliefs. They insist that “given the small units and remote locations in which special-operations forces typically operate, military commanders have determined...
  • COVID COVER-UP: Pfizer INTERFERES Just Days Before Massive FOIA Vaccine Data Drop, FDA Claims The Vaccine Manufacturer Must Help Review and Redact Documents Before Public Release

Just days before the FDA was set to release over 12,000 documents related to the experimental Covid-19 vaccines, Pfizer asked a federal court to allow it to intervene before any information is released to the public.Unsurprisingly, the FDA wholeheartedly agreed, asking the court to allow the vaccine maker to ‘help’ curate the documents, which would also buy the agency more time to release the much anticipated, and likely damning, data. (snip) Federal officials in the FDA and DOJ also told the court that they want Pfizer’s ‘help’ with redacting the documents because of “the unprecedented speed with which the Court...
  • FDA Asks the Court to Delay First 55,000 Page Production Until May and Pfizer Moves to Intervene in the Lawsuit...Somewhere on the other side of the growing heap of government and pharma lawyers is transparency.

As explained in prior posts, in a lawsuit seeking all of the documents the FDA relied upon to license Pfizer’s COVID-19 vaccine, a federal judge shot down the FDA’s requested rate of 500 pages per month and instead ordered the FDA to produce at the rate of 55,000 pages per month starting on March 1. Since the government has trillions of dollars of our money, it is putting it to good use by fighting to assure that the public has the least amount of transparency possible. To that end, it has now asked the Court to make the public wait...
  • Judge Gives FDA 8 Months to Release Pfizer Vaccine Data After Agency Requested 75 Years

A federal judge on Thursday ordered the U.S. Food and Drug Administration (FDA) to release Pfizer vaccine data within approximately eight months after the agency had asked for 75 years to fully comply with an extensive public records request. President Donald Trump appointee Judge Mark Pittman ordered the agency to produce 12,000 pages of Public Health and Medical Professionals for Transparency’s (PHMPT) request by January 31, 2022, followed by 55,000 pages every 30 days. The first round is due by March 1, 2022. Pittman wrote in part: “Open government is fundamentally an American issue”—it is neither a Republican nor a...

Dulles, Virginia – A federal courthouse is not typically the terrain on which Navy SEALs fight on behalf of their fellow Americans, but this week it proved to be a decisive venue for them. On January 3, U.S. District Judge Reed O'Connor issued an injunction against the Departments of Defense (DoD) and Navy, barring them from taking adverse action against 35 servicemembers who sought a religious exemption from DoD's vaccine mandate. The group includes Navy SEALs and other members of the Navy Special Warfare Command who hold strong religious convictions preventing them from taking the vaccine while remaining true to...

A federal judge on Thursday ordered the U.S. Food and Drug Administration to produce, at a rate of 55,000 pages per month, the documents it relied on to license the Pfizer-BioNTech COVID-19 vaccine. The rate of 55,000 pages a month would mean the FDA has just over eight months to fully produce all of Pfizer’s pre-licensure safety data. That is much faster than the 500 pages-per-month rate the FDA proposed in December 2021. That rate would have effectively given the agency roughly 75 years to fully produce the data, Aaron Siri, a lawyer working on the case, previously observed.

A federal judge on Monday barred the Defense Department from punishing a group of Navy SEALS who sought a religious exemption to the federal vaccine mandate.Responding to a lawsuit filed by First Liberty on behalf of the 35 special forces service members, U.S. District Judge Reed O’Connor, who pointed out that the Navy had not granted any religious exemptions, issued a preliminary injunction blocking the department from enforcing the mandate. "The Navy servicemembers in this case seek to vindicate the very freedoms they have sacrificed so much to protect,” O’Connor wrote in the decision. “The COVID-19 pandemic provides the government...

United's mandate "reflects an apathy, if not antipathy, for many of its employees' concerns and a dearth of toleration for those expressing diversity of thought," District Court Judge Mark Pittman wrote in his decision. United Airlines employees who have been granted exemptions to the company's COVID-19 vaccine mandate are allegedly being placed on indefinite unpaid leave, unable to seek employment elsewhere within the industry, access their 401(k) retirement savings, or file for unemployment. United Airlines Capt. Sherry Walker, who has been placed on indefinite unpaid leave, told Just the News that United employees seeking reasonable accommodation regarding the company's vaccine...

On December 13, a three-judge panel of the Court of Appeals for the Fifth Circuit affirmed an order issued by Judge Matthew Kacsmaryk of the U.S. District Court for the Northern District of Texas, enjoining the Biden administration’s June 1 termination of the Migrant Protection Protocols (MPP), better known as “Remain in Mexico”. The circuit court’s decision is a doozy, and I trust the Biden administration is chastened by the exercise. History of Remain in Mexico, and the Biden Administration’s Attempts to End It. Meanwhile, the FDA still has to comply with the original order to begin turning over documents. Lo and behold, the first release is a bombshell. According to an official Pfizer document that is titled Cumulative Analysis of Post-Authorization Adverse Event Records Reports, in just the first 90 days of the vaccine’s roll out under the FDA’s EUA – from December 1st. 2020 – February 28th, 2021 – there were TENS OF THOUSANDS of reported adverse reactions, including OVER 1200 DEATHS. The report only included adverse events to the vaccine that researchers considered “serious cases,” there were thousands more submissions that...

Remeber how the FDA a few weeks ago did not want a federal Judge to let any of the Pfizer drug information out from the first few weeks when they started to do the injections back January? The Food and Drug Administration (FDA) released the first batch of documents related to Pfizer’s Covid-19 vaccine after a federal judge ordered that they must comply with a massive Freedom of Information Act (FOIA) request that was filed by a government accountability group called Public Health and Medical Professionals for Transparency. The esteemed group of more than 30 professors and scientists asked the federal government to share any and all data that factored into the agency’s hasty decision to grant Pfizer’s experimental mRNA vaccine an emergency use authorization (EUA) – which amounts to a trove of over 329,000 documents. President Joe Biden’s border chief is making a second effort to cancel the “Remain in Mexico” (RIM) program because it hinders migrants’ ability to ask judges to let them stay in the United States. The United States is a “nation of immigrants,” border chief Alejandro Mayorkas claimed in a 39-page report that was prepared for a federal judge who directed in August that the program be kept going. Mayorkas, who is the secretary at the Department of Homeland Security, ignored the benefits to Americans of the program even as he described the risks and harms to migrants. Mayorkas also ignored...

Southwest Airlines employees now know the date they must provide proof of COVID-19 vaccination to their employer, or face being placed on unpaid leave. A federal judge denied the Southwest Airlines’ Pilots Association (SWAPA) petition to temporarily strike down the carrier’s December 8, 2021 internal vaccination deadline, along with their entire lawsuit against Southwest alleging violations of the Railway Labor Act. Mandatory Vaccination Will “Improve the Safety of Air Transportation” The pilots union representing roughly 9,000 pilots working for the Dallas-based airline originally sued the carrier in August 2021, claiming the working conditions under the pandemic broke the “status quo”...

Southwest Airlines asked a federal court to reject a lawsuit filed by a Southwest pilots union to temporarily block the company from carrying out its COVID-19 vaccine mandate, arguing the order would put its business, customers, and employees at risk. Earlier this month, the Southwest Airlines Pilots Association (SWAPA) filed a lawsuit to prevent the carrier from mandating that all its workers get vaccinated. The union asserts that Southwest, which last week experienced thousands of flight cancelations and delays, illegally changed work rules instead of negotiating with them. “The injunction that SWAPA seeks is extraordinary,” Southwest’s lawyers said in its...

NEW ORLEANS — A federal appellate court refused late Thursday to delay implementation of a judge’s order reinstating a Trump administration policy forcing thousands to wait in Mexico while seeking asylum in the U.S. President Joe Biden had suspended former President Donald Trump’s “Remain in Mexico” policy on his first day in office and the Department of Homeland Security said it was permanently terminating the program in June, according to the court record. U.S. District Judge Matthew J. Kacsmaryk last week ordered that the program be reinstated Saturday. The Biden administration appealed to the 5th U.S. Circuit Appeal in New...

On April 13, 2021, the State of Texas and the State of Missouri filed suit against President Joe Biden, the United States, and the pertinent US agencies and officials challenging the suspension of the program. In a 53-page opinion (see below), Judge Kacsmaryk, who was appointed by President Donald Trump, upheld the “Migrant Protection Protocols” (MPP) put in place by the Department of Homeland Security during the Trump administration. Under the MPP, the “Remain in Mexico” policy returned some migrants to Mexico pending their removal proceedings. Judge Matthew J. A federal judge ordered Homeland Security to restart President Trump’s “Remain in Mexico” policy, ruling Friday that the Biden administration cut too many corners when it scrapped the get-tough approach to illegal border crossers. Judge Matthew J. Kacsmaryk said Homeland Security Secretary Alejandro Mayorkas rushed to scrap the policy, officially known as the Migrant Protection Protocols, without considering the benefits of pushing border jumpers back across the boundary to Mexico to await their immigration court dates. Particularly at a time when the government is defying U.S. law by catching and releasing illegal immigrants that are supposed to be detained, the...
