Only legal contracts are enforceable in a court of law. If the consideration given either way was patently illegal e.g. giving a bribe, accepting a bribe, buying political influence, abuse of office, etc, then Hillary’s “clients” have no legal recourse and simply have to absorb their losses.
I don’t think they would admit it was a pay for play and Hillary certainly could not bring it up.
So the only legal grounds anyone would have is based on something along these lines:
"I contributed to the Clinton Foundation because they said they were [helping people in Haiti, helping people in Africa, etc.], but they just used my money to pay their own salaries and pay for Chelsea's wedding."
A pardon from crimes for which a person has not been convicted, much less indicted, is an oxymoron.
Yeah the idiot Ford did it for Nixon, but it should have been contested, even to the SCOTUS if necessary.
If Traitorobama pardons Traitorhillary without her being convicted or even indicted, Trump should rip up the pardon as meaningless, and proceed to have his DOJ indict her (though maybe after the SCOTUS has a 9th conservative justice).

I think Trump needs to pick an outstanding Attorney General and then leave it up to the AG to decide how to proceed. Trump will have more important problems to deal with, and it should not be something that can be portrayed as a political payback to an opponent.
Remember the case of Spiro Agnew. He pled nolo contendere, paid a fine, and resigned his office. His crimes were penny ante stuff compared to Hillary, and he had the office of Vice President as a bargaining chip, but maybe something like that could be worked out. Of course the fine would need to be orders of magnitude higher. Perhaps $1,000 for each document that was destroyed and $10,000 for each classified document that was handled carelessly. But Obama may limit the options by giving her a pardon.
He can't pardon the Clinton Foundation. That investigation can proceed.

Other people having a bad day may include Lois Lerner and John Koskinen (sp?) over at the IRS. A lot of shenanigans at DoJ depended heavily on Hillary be elected.
A special prosecutor is not one person, he has a whole team working for him including a grand jury so he can issue supeanas and have people testify under oath, and of course the FBI still does it's job and turns over what it finds.
Appointing Special Prosecutor would be the biggest mistake Trump ever made. Trump would insert himself into the process for no good reason
Just the opposite is true. Trump wouldn't be appointing him, the AG would. And by giving it to a special prosecutor they avoid the charge that the prosecution is political and Trump is politicizing the DOJ. And it allows Trump to move on and get the business of the country done. And finally IT'S WHAT HE SAID HE WOULD DO.
Back on the speaking tour. There’s a lot of money in not being president. She’ll never get indicted. Nobody who actually hangs out in the halls of power wants to cross that Rubicon.
Pardoning Clinton doesn’t necessarily let Obama & Co. off the hook. The evidence against them still exists in the emails & in the Clinton/Obama stooges. Obama would have to pardon a long list of people (Huma, Cherly Mills, Podesta, ...) who are involved & liable to prosecution. It would look real bad.
If Obama pardons Clinton it may make Trump real mad. Mad enough to investigate Obama & Co., who had to know Clinton was violating the law with respect to classified material. That makes Obama & Co. liable for prosecution.
OTOH, I believe Trump might be satisfied to only go after Clinton & Co., leaving Obama out of any prosecution, but only if there are no pardons. Prosecuting a past president is unprecedented, likely difficult & dangerous, but doable.
So, Obama had better think real hard before making the Donald mad just before he takes office.

OTOH, what about the foreign countries and others that donated millions, and now there is no pay-for-play?
This is going to get very interesting as it all unfolds. The Clintons had better be prepared to start returning these funds asap. It could get ugly,
Picture a 6 million dollar donation for a specific deal that will have no chance of happening due to the non-election of Clinton.

Another thought on the pardon.
If pardon, she could still be called in front of a grand jury and because she has been pardon she could not use the 5th Amendment to keep quiet as she would not be prosecuted for any evidence against her, but if she lies, that is a new crime.
I am not sure how many “I don’t recall” answers you get before you get a contempt of court and sent to jail until you do remember.
