What should you do if blindsided by a vague accusation from high school 35 to 38 years ago

Someone accuses you of doing something at a party when you were in high school.

There is no evidence. There are no details. It supposedly happened at an unknown time and place.

At first, the accuser is unknown and refuses to give her identity. Then she makes her identity public.

She goes to the media. She refuses to answer any questions about what happened, her motives or her history.

She is a political activist who has a political motive for making a damaging accusation.

What would you do?

I’m both a lawyer and an elected official (commissioner) in a teeny-tiny county. I and my wife have been slandered numerous times on social media, mostly a public FB “Discussion” Page. But as a “public” official, under the NY Times v. Sullivan case the standard for establishing defamation is gross or reckless indifference for the truth, which is a much higher bar than ordinary falsehoods. Nevertheless, there are many reported cases where an elected official successfully brought such defamation cases and received large judgments against the defaming party.

I have not hesitated to send required (by law) pre-suit demand letters in circumstances where I was certain I had been egregiously defamed. Each time the person has issued a public apology on their personal and the public FB page. Which is all I really wanted or have time for.

Sue if you must to prevent this BS. Truth is the slandering party’s burden of proof.

here’s mine: junior or senior year of high school. Backyard party at a female classmate’s house. Probably no alcohol. A bunch of girls went out to the front of the house and started walking like a pack up the street. Bunch of guys, including me, decided to chase them. In retrospect, it brings to mind a herd of deer. None of us had any idea what we were doing. I eventually grabbed a girl around her chest and got my first feel. It was not really enjoyable, just instinctive. One of the guys did see me do it and made up a story (to make me feel bad I think), that the girl went back to the house and was upstairs crying. There was no evidence of this, but I just felt really really bad. Still sort of feel bad, 50 years later.

Kids are so dumb and impulsive. So I guess I can’t be on the supreme court now.

I am of the personal opinion that everyone, male and female, has at least one unwanted sexually related experience in their lives, if not several. If someone states they haven’t, they are most likely suppressing the memory. Of course, there is no way to prove my theory. In most encounters, there are only two people involved, each with their own version of the truth.

My advice, unless you were physically harmed in some way, get over it, and move on with your life. Don’t blow it out of proportion. (No pun intended.)

Seek an attorney and begin looking at civil suit for defamation and other remedies to my besmirched character; make her prove in open court what she has declared publicly….

I would not let her go.

Back around 2005 an employee at my plant was arrested and accused of molesting his young teenage daughter's girlfriend.

After suffering the humiliation of being jailed, having his name in the paper, being called a monster by the arraigning judge, hiring an attorney to defend himself, it was ultimately discovered that the girl lied and was asked to make the charge against him by the ex-wife who was trying to gain custody of the daughter........

I was pretty much a wall flower in H.S.

While a Sophomore, I went to a basketball game and two girls sat in the bleachers behind me. One told the other this joke:

One guy says to the other “What’s this”.

“I dunno.”

“Beats me.”

My ears burned but I didn’t turn around. Then I heard “I bet this guy’s getting an earful.”

I never did see who they were.

Hey, can I claim sexual harassment? I think it was 1963, but that’s about all I remember.

Fighting back is the only proper response for an innocent person.

* Complete and unequivocal denial.
* Threats of legal action if the accusation isn’t immediately withdrawn and a public apology given.
* Actual legal action, as needed.

The wife should lose custody of her daughter altogether and spend 5 years or so behind bars for conspiracy. She should also be sued by the ex for everything she is worth(If anything) and all future net worth as well for the damage she caused the husband. Until this starts happening women will continue to pull this BS.

1983 I started college at Michigan State University. My dorm room was right next door to the room where an infamous gang-rape occurred the year before. The press were everywhere when it came to trial. It was a sordid story with a lot of unanswered questions. This left an impression.

1986 In another dorm, a drunk girl stumbled in at 3am one night, wearing only a nightgown. She climbed on top of me and kept mumbling, “Where’s Chandler?”

Chandler was the frat boy next door. All the sorority chicks dug him. Now, with this drunk chick lying on top of me, my memories 1983 popped right back into my head. I jumped up and ushered her back across the building to the ladies’ side of the building, finally finding the room where she was staying. I didn’t sleep well that night because I knew that she could have said literally ANYTHING and she’d be believed.

Slightly off topic, but one day, I was at a youth event and was holding up some lost and found items. I made an quiet off mic joke about singing some songs to get the items back.

Some old guy, who I did not know heard my comment and accused me of child abuse.

I got in his face just enough to make sure he never, ever accused me of that again.

In our organization, we’re not allowed to be alone with a kid. Once, a boy had an accident just as the others were cresting a hill. Being in the back of the group, I ended up alone with him for a couple minutes where we hatched a plan. As soon as we crossed the hill, I apologized for spilling my water bottle down the front of his pants. (as we were concocting this plan, I made the mistake of saying “this will be out secret.” Good thought, horrible choice of words.

I let the other leaders know what happened and as soon as I was able, I also called his day, just for some transparency.

It's an interesting question, and there's an angle to this that Democrats might want to consider:

I'm wondering if President Trump nominated two U.S. Supreme Court justices who attended all-boys prep schools that seemed to be all-white in those days -- specifically to reduce the chances of having a racial or sexual allegation surface from those days.

Do the Democrats really even want to consider such a possibility?

They made the claim.

It's up for them to prove it.

My basic response to every charge would be 'Prove it'.

If interviewed by a third party (Cuomo CNN) I would respond with, 'Were you there? Do you know any of this is true? Can you provide proof this happened? Why do you believe her and not me?'

Don't bother giving any defense. Just keep hitting them with, 'Prove it'.
