Michael Flynn Lawyer Sidney Powell ‘Mystified’ By Judge Sullivan’s Partisan Actions, Lays Out Next Steps

Sidney Powell, attorney for Michael Flynn, appeared on Fox News yesterday to discuss the latest actions by Judge Emmet Sullivan. If you aren’t aware of his latest machinations, he’s essentially stalling on approving the motion to dismiss put forth by the DOJ, instead appointing a rabid partisan to argue against it. Not only is that almost unheard of, he’s also asking for amicus briefs from political actors in a criminal case, another move that is not only twilight zone stuff, but likely not even allowed.

In the interview with Sean Hannity, Powell described herself as being mystified by Sullivan’s gamesmanship.

Ironically, Powell has spoken highly of Judge Sullivan in the past, leaving her more perplexed as to why he would behave this way. As she continues in the interview, she points out that there have been numerous Brady violations against her client, that the government was shown to have lied about document production, and that both sides are asking for this to be dismissed. There is no logic behind Judge Sullivan’s gambit to continue to persecute Flynn.

That leaves only one real possibility, one which Powell obviously can’t speak to right now because it could endanger her client. Namely, that Judge Sullivan is simply a partisan hack making political moves to damage Flynn and Trump before finally capitulating and granting the motion to dismiss. If anyone’s got a counter explanation, I’m all ears.

Regardless, Powell did appear on another Fox News show later that night and gave more context and some next steps

As she says, Judge Sullivan is in direct defiance of several precedents, including one recently set by the Supreme Court (written by Justice Ginsberg, no less). Powell also revealed that they are working on several motions that use those precedents and decisions as a basis to stop this nonsense. That’s likely what we’ll see in the next few days. If the judge continues to ignore the fact that he’s clearly violating the law, then this will almost certainly end up fixed by an appeals court. It’s so ludicrous that I don’t even think it has to make its way to the Supreme Court before Judge Sullivan is slapped down.

What we’ve seen here is an abuse of the justice system that can’t stand. Even though it’s a foregone conclusion that Flynn ends up a free man here, something needs to happen to this judge for what he’s done and continues to try to do. We can not continue to operate like this and still claim to have a system that’s blind. Currently, we don’t – Period.

A pardon is the last resort because accepting it is an admission of guilt.

Best to play this out to the end in court.

If Biden was to win this is still up in he air,then a Pardon would make sense.

With all of the widespread illegal domestic surveillance going on in the Obama administration, who’s to say they don’t have something on Emmet Sullivan, and they let him know it.

I expect the so called judge to have the hearing televised.
So Flynn’s lawyers should lay out the whole coup attempt timeline.

If Biden was to win this is still up in he air,then a Pardon would make sense.

I agree. Flynn should consider himself exonerated and a free man. Trump should let it play out and use the pardon card after the election, regardless of the outcome. I just hope Flynn has the mental discipline and peace of heart not to let the delay bother him. Somehow I think his military experience has prepared him well.

I thought Sullivan was a while hat, until someone pointed out to me he dragged Ted Steven’s case through the election, almost certainly causing him to lose, and never followed up on his complaints about the prosecutors.

The reason they want to force a pardon is because it lends credibility to the mueller investigation. Once the Flynn persecution fails, it makes clear the sleazy and extreme lengths they had to go to find anything to charge. It also sheds light on the Stone persecution. Not that any should be needed after the swat team show they put on to arrest him.

I am betting that 'when the good judge is invited out to one of the worlds best restaurants in DC it's not by conservative leaning friends. Nope, if he wants to get the star treatment he needs to keep the show going. Could all just be simple narcissism. And there are plenty of political hacks willing to pay to influence a judge on a case that they want to go their way.

Methinks that “Judge” Sullivan, being a liberal and therefore proudly carrying the standard of double standards, really hates the fact that a woman has made him look like the simpleton liberal shyster that he is. If he’s a judge, well, no use respecting that soiled profession any more.

She’s beat his silly *ss at every move and she’s going to do it again.

As we all know, the folks who do not respect women are - wait for it - liberals/progressives, not conservatives.

I have to think that Sullivan is trying to get himself removed from the case, to drag it out further, give the left more excuses to wring their hands, force Trump to finally pardon the victim, etc.

He did not ask for input as to what he should do from friend of the court brief. He specifically asked for an opposition brief to the criminal defendant’s case from an outsider who had never been attendant to the hearings. At that very point, he is no longer a neutral arbiter and he should recuse himself, but he won’t because he is a partisan Democrat judge practicing political stagecraft from the bench.

In the past Judge Sullivan has had a reputation for holding prosecutors accountable for misconduct.

The only thing that makes sense to me here is that he is also a #Nevertrumper and that side of him is winning. Still, deep down he has to realize he's acting illegally himself.
