I was under the impression that only state legislatures can change a state’s election laws. Not Federal judges.

I don’t fault Trump for this, as he was likely just having a subordinate pick out possible appointments because...he likely delegated that and had to trust advice before approving the appointment.

We know how many swamp denizens were advising him.

Perhaps it’s worth considering the idea of outsourcing our elections to Argentina’s capable hands? That might ensure we learn the results within a day and alleviate concerns about Democrats cheating.

Go review the history of how Hugo Chavez took over Venezuela. One of the major contributing factors were a series of blatantly unconstitutional and totally inexplicable High Court legal rulings contrary to the rule of law that removed any block on his ambitions and enabled his consolidation of power.

Leaving aside the issue of federal overreach, and of distaste for the easy-peasy mail ballot approach making it sooooo easy to ballot harvest . . .

(I love the great success the RNC has had of standing up a ballot harvest strategy. /sarc). . .

Isn’t this ruling logical on the facts in view? If the ballot is received by election day, the missing date makes no difference, substantively, though it is a process error. What am I missing? It may have been filled out I guess too early?

This ruling is not as outlandish as it seems. These courts have ruled that the placement of a written date on a ballot envelope is of no consequence if the ballot is received on time. If it’s a mail-in ballot, the postmark is a more accurate and useful piece of information anyway.

Pennsylvania’s election law is so poorly written that it requires a written date to be marked on the ballot envelope, but it doesn’t even require the date to be ACCURATE. So a ballot mailed in 2024 would be considered valid even of the date on it is July 4, 1776 or February 31, 2024.

Didn’t we just learn that elections must be held on a single day, and any “period of time” election like week, month or season, is a violation of the Constitution?....

I know that came out last week somewhere.

Mail-in ballots in Pennsylvania without accurate handwritten dates on their exterior envelopes must still be counted if they are received in time, a judge ruled Tuesday... Baxter said the date — which is required by state law — is irrelevant in helping elections officials decide whether the ballot was received in time...

I can see the logic in this, IF AND ONLY IF it is just the date that is missing from the outer envelope.

As long as the ballot is received prior to the deadline, it doesn't really matter what the date on the envelope says. The arrived ballot proves itself.

What am I missing with this interpretation?

According to the Supreme Court in Bush v. Gore (2000), no court has the authority to create or change election law as established by State Legislatures.
