The new Congress gets seated I believe on January 3rd.
The date Congress can nullify the EV's is of course January 6.
So it's not the make up of this House this session that matters when nullifying the EV's.
I would be more concerned this session with the Democrats using their possible new majority to legislate for amnesty and/or illegals to be eligible to vote this November.
You are correct and these wackos from this article failed to do any research. Probably had a deadline to file by for pay.
The new House takes office Jan 3. Biden’s term of office ends Jan 20. They do not get to remain in office because the House refuses to seat the new President.
Besides which, they have quite a few non insane extremists on the Dem side. They would likely not have the votes to stop the constitutionally required Electoral Vote counting.

The left doesn’t need to wait and take the risk that the House will end up with even a larger GOP majority after November. If they get one or two more to resign before the elections and take the majority, they can declare Trump an “insurrectionist” and declare him not eligible for the Presidency no matter the outcome of the November elections.
Good catch.
