If Biden Is Replaced on Democrat Ticket, What Happens to Ballots Already Cast For Him?

Something is definitely going on with Joe Biden. His campaign this morning called a "lid" for him for the day which means he is remaining at home. I checked for tomorrow and again, he has no campaigning scheduled. In fact, so far I have seen NOTHING scheduled for him for next week.

In effect, his campaign has ground to a halt. Yes, there is definitely something going on behind the scenes. Probably a medical situation.

It take no stretch of the imagination to see that the Democrats might have to replace Biden on the ticket. However, since voting in several states have already begun, the question is what happens to those ballots already cast? You can't assume that just because a voter cast his ballot for Biden that it should automatically go to whatever Democrat they replace him with, such as Hillary. In fact, the Constitution does not even refer to political parties.

Also what happens to all the mail-in and other ballots already printed up? Would they have to be ditched?

They become worthless. You vote for a person, not a party. That is the risk you take with early voting.

Not true. You vote for a slate of electors in the electoral college. The electors are pledged to a particular candidate.

If Biden runs out of steam before the election they try to substitute someone else. Although there will be court battles over "faithless electors" and requirements to be on the ballot.

It will be as exciting as it gets. Trump's odds improve with every new development.

Probably Kamala gets the votes and if they win she is your President. I think it would be a constitutional crisis.
You couldn’t assume the voters would vote for as the head of the ticket.

Maybe, maybe not. Yes, you are voting for a slate of electors that are pledged to vote for Biden. If the Biden vote won that state, that would be the electors that vote in the EC. But at that point, they are no longer obligated to vote for Biden and are not pledged to any other candidate. So you could have a case where electors across all of the Biden won states could be voting for various Dems. You could see votes for Bernie, votes for Hillary, votes for Kamala, etc. Could make for an interesting election.

No. You don’t vote for a person or the party. You are voting for Electors pledged to vote for someone. If the someone is gone, they will vote for someone else. Since all Electors are party stalwarts, have no illusions on who they will vote for if Biden is ‘gone’.

Since this has never happened before at the Presidential level, I guess the SUPREME COURT gets to make the call. Oh well, bummer for the Left.

Remember, votes are NOT for the president. Votes are for the ELECTORS. Who will vote as instructed. So if there is a swap (which there won’t be, and all this what if is pure alt-history nonsense) then the electors who were chosen to vote for the Democratic candidate will vote for the Democratic candidate.

It depends on a hodgepodge of state laws and is impossible to predict at this time. In fact, it may be too late to replace Biden even on Election Day ballots in some states. Now that the Supreme Court has held that faithless elector laws are enforceable, replacing Biden could easily result in Democrat electoral votes being split between two or more candidates, increasing the chances of a contingent election if Trump does not win an outright majority.

Biden will not be replaced. Don’t underestimate Biden in the debates and the help he is getting from the MSM. Trump has a winning message and a great campaign and that’s what can win this.

Can a brain aneurysm cause personality changes?

After a Brain Aneurysm survivors and family members say one of the most difficult emotions to handle is anger and frustration. Most survivors would describe themselves as having a personality change or a lack of impulse control due to anger.

If anyone can push Biden’s buttons,Trump can. I can see him losing it during the debate. An increase in anger increases blood pressure which is trouble for aneurysms as they hemorrhage.

Biden needs to make a statement, live, about RBG _today_. That’s not hard and not unreasonable. His team knew this was coming, just needed a statement ready for Joe to read.

Instead of lead, Democrats get “lid”.

If you caught his reaction to RBG passing then you would see what l mean it was a good rational statement with no prompter and even som me off the cuff reflections. Yes he can go into hiding and rest up after every outing and get away with it because MSM will let hm. Unless there is a big change he will not be replaced. If he was that bad he would already be gone.

Depending on state law, electors may be bound to vote for the specific candidate on the ballot, and their party may not have the power to direct or allow them to vote for a replacement. The Supreme Court has held faithless elector laws to be enforceable, and some call for the immediate, automatic disqualification and replacement of and invalidation of the vote of any elector who fails to vote as they are bound.

But they’re bound to do the bidding of the state legislature. Who will just slam through a law saying “vote for who the party replaced the guy with”. It’s not that tough.

They would have liked to, I very strongly suspect, in order to keep that seat locked down for the rest of Trump’s term, but it’s pretty hard to do once you announce the death.
