MEDINA CAMPAIGN HOSTS STATE SOVEREIGNTY SYMPOSIUM

Medina has made state sovereignty a key component of her campaign and says often, "Not one more inch Washington D.C., not one more inch in Texas." She champions the use of nullification and interposition by the state as the proper remedy for halting unconstitutional federal mandates and has issued a call to action encouraging a special legislative session in Texas specifically to nullify nationalized healthcare.

I've been supporting her from the first, and continue to support her. I think she is far and away the most conservative, constitutionalist candidate in the race for Texas governor.

I hope that TX freepers will support and vote for her, too, and quit saying she doesn't have a chance. She certainly can't win if people who really like her but think she doesn't have a chance vote for someone else!

Nullification is an interesting subject indeed. Start with the broad principle:

When South Carolina tried to nullify a federal law, Andrew Jackson mobilized the US Army, and threatened to hang any supporter of nullification in the State. They believed him, as he was fond of hanging, and generally bloodthirsty. So they reversed their nullification vote.

The Supreme Court has heard two cases with important variations of nullification. In the first, they decided that laws passed by the US Congress were superior to laws passed by State legislatures. In the second case, they decided that federal courts were superior to State courts.

This matters, because the SCOTUS has *not* heard a nullification case about the US President vs. a State governor. This mattered most recently after hurricane Katrina, when George W. Bush wanted to act, but the governor of Louisiana wanted to dither, so there was a stalemate.

In past, it was far more serious, going back to the beginning of the US, because it meant that the presidents have threatened, and have used force to impose their will on individual States. And this means everything from George Washington’s Whiskey Rebellion, to the US Civil War, to President Eisenhower sending the 101st Airborne Division to force integration in Little Rock, against the Arkansas National Guard.

In the case of Obamacare, this means:

1) Congress orders State legislatures to obey. The SCOTUS might likely back that decision, based on Prigg v. Pennsylvania (1842). And then,

2) Federal judges might order the State to comply. And the SCOTUS might back *that* decision, based on Ableman v. Booth (1859). But then,

3) Would Obama threaten the use of force to make States obey? Already there is a movement among military officers to refuse to carry out such orders, as unlawful. But this is an extreme case. More likely, the federal government would use other coercion, such at it has already tried in different issues, such as:

4) The cutoff of all federal funds to uncooperative States. The revocation of the authority to prescribe medicine by physicians in the State. And the levying of fines by federal judges against the State.

In other words, the feds will fight hard against nullification, and they have and will always back their power over State power.

Larry Kilgore the secessionist from Mansfield, Tx has withdrawn from the Gov. race and endorsed Debra Medina. Here’s a little info on that:

Larry Gilgore, former Republican Guberntorial candidate best known for his secessionist political stances, has announced he is withdrawing from this year’s contest and throwing his support to GOP gubernatorial primary candidate Debra Medina. Kilgore received just over 50,000 votes representing less than 8% of the 2006 GOP gubernatorial primary vote, over 225,00 votes or 18.5% of the 2008 U.S. Senate primary vote against John Cornyn.

I, Larry Kilgore, officially withdraw from the Texas Gubernatorial race. Thank you campaign supporters for all your hard work. The campaign has always been about Texas Secession and not about me; therefore the campaign for Texas Secession has not ended. I will continue to work with others to protect individuals and local governments from US and Texas government oppression.

He then offered his official endorsement on Facebook, where he had gathered over 2,500 supporters.

Debra Medina - Please accept my endorsement. I encourage the 226,000 Republicans that voted for me in 2008 to vote for you. Your character and actions will restore honor to the office of Texas Governor.

Basil I know you’ve had contacts with Ms. Medina and hosted a fundraiser for her. If you have a way to contact her or her campaign I’d offer the following as a topic on which she may want to campaign.

The Texas Army/Air National Guard problems that have been uncovered in the last couple of years and the handling of such by the Governor...
