Absolutely. The IRS will be enforcing it, and the IRS already routinely removes unpaid taxes from bank accounts.

As of right now the law says no. But if the feds need some dough for the latest Obama vaca, you know where they are gonna get it from.

Bottom line is the IRS no longer follows the law (Lois Lerner) so all bets are off.

I’d think twice before logging on to their website. It’s got to be the most efficient way for the feds to determine who needs health insurance.

No. The Affordable Healthcare Act explicitly prohibits it.

The language in question is actually on page 131 of the PDF:

(g) ADMINISTRATION AND PROCEDURE.—

(1) IN GENERAL.—The penalty provided by this section
shall be paid upon notice and demand by the Secretary, and
except as provided in paragraph (2), shall be assessed and
collected in the same manner as an assessable penalty under
subchapter B of chapter 68.

(2) SPECIAL RULES.—Notwithstanding any other provision
of law—

(A) WAIVER OF CRIMINAL PENALTIES.—In the case of
any failure by a taxpayer to timely pay any penalty imposed
by this section, such taxpayer shall not be subject to any
criminal prosecution or penalty with respect to such failure.

(B) LIMITATIONS ON LIENS AND LEVIES.—The Secretary
shall not—

(i) file notice of lien with respect to any property
of a taxpayer by reason of any failure to pay the
penalty imposed by this section, or

(ii) levy on any such property with respect to 
such failure.

Unless you’ve used direct deposit for your tax returns, I’m not sure how they’re supposed to keep track of “your” accounts.

Given the various iterations of ways to file (married filing jointly, separately, head of household), it seems like it would be a nightmare to implement.

I've been telling you...the whole idea is to find out what you own and how they can grab it. It's also one of the reasons everyone will be required to file electronically.

They can also put a lien on your property. So that old look back applied to Medicare will be void. They gotcha from the other direction.

H.R. 3590 gives the federal government specific access to individual bank accounts and medical records as provided by that individuals health plan. The government may monitor an individuals finances and medical records electronically, for the purposes of determining an individuals eligibility for certain programs under the bill. They may also monitor an individuals finances and medical records to ascertain whether that individual has health insurance and is making regular premium payments to an approved health insurance plan; this will allow the federal government to determine each individuals financial responsibilities with respect to penalties and fees prior to or at the point of care as outlined in the bill. This clause also gives the government the ability to transfer funds electronically to or from an individuals bank account for the purposes of debiting his/her account for fees and penalties.

The stated purpose of this clause is “to reduce the clerical burden on patients, health care providers, and health plans.”

Quick note for those of you who say “the government already had access to our bank accounts.” That’s true, but it was previously required that they obtain a court order to access any individuals personal finances. This bill provides them free reign to do so whenever they please.

No the law was written to exclude the IRS’s normal collection “techniques”.

I believe the only ways for them to get it is to withold it from any refund you may be due on federal taxes or if you apply for some kind of federal financial assistance.

Odd. So much of the government is shut down. However, someone who got into the sign up, saw the premiums, and chose opt out, got their notice of fine e-mail from the IRS threatening to kill their driver’s license and put a lien on their home.
