Bunkerville Standoff Breaking: DOJ Wants Dismissal Of Charges Reconsidered, But Wants.....

THE DEPARTMENT OF JUSTICE HAS ASKED US DISTRICT JUDGE GLORIA M. NAVARRO TO RECONSIDER HER DISMISSAL WITH PREJUDICE OF THE CHARGES AGAINST CLIVEN BUNDY, AMMON BUNDY, RYAN BUNDY AND RYAN PAYNE.

THE DOJ'S DISCOVERY EVIDENCE EXPERT HAS APPARENTLY WEIGHED IN ON THE CASE AND WANTS TO BRING BACK THE CHARGES AGAINST THE BUNDY'S AND RYAN PAYNE.

WHEN THE DISCOVERY EVIDENCE EXPERT WAS BROUGHT IN LAST MONTH, THE DOJ OF ATTORNEY GENERAL JEFF SESSIONS SAID IT WAS TAKING THE CASE 'SERIOUSLY'. WE NOW KNOW APPARENTLY WHERE THE AG AND DOJ STAND.

Meanwhile, federal prosecutors in Las Vegas want the charges against the remaining four defendants dismissed with prejudice. A motion was filed today in US District Court.

Dave Bundy, Mel Bundy, Joe O'Shaugnessy and Jason Woods were set to go on trial February 26th.....

Good news for the four “Tier 3” defendants who were facing decades in prison on piled up felony charges, but the DOJ wants to reverse the judge’s dismissal of charges against the key defendants in Tier 1 (Cliven, Ammon and Ryan Bundy along with Ryan Payne).

If it has been dismissed WITH PREJUDICE, then it cannot be reconsidered. The case is over. Done, Finished. Reversing that dismissal makes it double jeopardy. Sorry, dumb-kops, you blew it. The over-the-top misconduct of your prosecution killed it.

It looks like they masked the request for the judge to reconsider with dismissal against major defendants with the move to drop charges on minor defendants.

The only reason for a motion to reconsider is to clean up the record for appeal. Any attorney will tell you that the probability of a motion to reconsider going anywhere is about 1 in a zillion.

It is weird to see the request to dismiss charges against the last four defendants with prejudice alongside a request to reconsider the dismissal with prejudice by the judge of the key defendants in the case.

I get the sense that DOJ is CYA’ing itself and the prosecutors who should be disciplined or fired for their willful and deliberate hiding of evidence in the first place.

Hmmmn. “The prosecutors” want the charges dimssed with prejudice.

“That” is “interesting”.

Would it not mean that (Session’s/Trump’s) DOJ is NOT demanding endless retrials to “justify” Oboma’s previous unsustainable charges?

I am confused. The case was dismissed with prejudice. How can you un-dismiss a case once it was dismissed with prejudice. If effect the DOJ is saying this judge does not know what she is doing? This might really piss the judge off?

It should be noted this judge bent over backward for the DOJ during the trial. When their actions became totally egregious she dismissed with prejudice.

I was just thinking. You would think that the DOJ would be a bit to busy to be worrying about the Bundy’s. I mean they need to be getting busy bringing there own people to justice. Much for them to do there.

They accept for the moment that charges have to be dropped but their decision to ask the judge to reconsider sets the state for an appeal of her decision to dismiss the case with prejudice.

The Sessions appointed US Attorney in Vegas Dayle Elieson and the DOJ “discovery evidence” expert are agreeing with the notion of appealing the judge’s dismissal is the way it looks.

The DOJ frankly isn’t doing anything to discipline the prosecutors.

Their names are still on the court documents. They are participating in actions to set up an appeal of the judge’s deicsion dismissing the case with prejudice.

An appeals attorney and the new Jeff Sessions appointed US Attorney in Vegas, Dayle Elieson, are participating in the process.

Please leave Sessions alone. You don’t understand the stress he is under.

His two predecessors as AJ were so far ahead of him in effectiveness he has alot of catching up to do.

You have to admire his effort to outdue them. Unfortunately, it is all towards the goal of flipping off Trump, covering up for DoJ/FBI criminality, obstruction of Congress, attacking Americans.

Holder and Lynch are actually quite proud of him.
