How Did George Floyd Die?
May 28, 2020 | Street_Lawyer

Not enough is known to say if the officer is legally responsible for Floyd’s death; however, it appears that the officer may have used excessive force, as we will explain later. The George Floyd case is not over and may never be over, especially if a jury acquits the officer. Let us wait before we let our emotions rule our judgement. Also let us wait until we know all the facts.

We are assuming that what the officer did caused Floyd to die. Putting pressure on the carotid artery could cause the victim to pass out and even cause brain damage or death. Having said that, to convict the officer of murder in any degree, the medical examiner must testify that whatever the officer did was the proximate cause, or some might say the causation in fact, or the substantial and operating cause of death and not something else. It can get extremely complicated. Especially if the victim died hours later, rather than while under the knee of the officer.

This case looks like an open and shut case to the layperson, but legally it can be complicated. So as not to reignite the embers a jury might convict the office of unreasonable use of force. Jurors are not computers and will exercise their own judgment even if they are not following the judge’s charge to the letter.

The video shows Floyd cooperating with the officer prior to going toward the police car. The officers had already handcuffed Floyd. We don’t know what happened between the sidewalk and the officer holding Floyd down in the street. But since they handcuffed Floyd, why didn’t the police officer put Floyd the police car or make Floyd lay flat on his stomach in the street. Was the officer waiting for something. Did the officer know he was on videotape? If so, it is not likely that the officer thought he was killing Floyd.

There are two pressure points on each side of the neck, it appears that the officer didn’t have his knee on Floyd’s neck, but if he did, he could only choke off one side of the blood flow to the brain. That fact is significant when it comes to testifying as to the cause of death.

Finally, was a body bag removed from the scene? Was Floyd dead before he left the scene of the incident? All these factors will be important in determining guilt. But since everyone has already convicted the officer of murder, if the jury acquits the officer of murder, we will see violence in the streets of this nation like we have never seen before.

He'd be alive if the officer hadn't killed him too.

His neck was compressed laterally. This opens up the possibility of causing a stroke by compromising cerebral blood flow from the external carotid arteries. By reducing blood flow this could create ischemia, and lead to infarction (stroke)

Could have been asphyxiated as well, doesnt take too long too kill that way.

Tracheal disruption or fracture is also possible, which could cause swelling and loss of a patent airway in that way.

Thanks for injecting some sanity.

This is the worst electronic lynching I have seen.

Worse than Ferguson Missouri.

The time between moving toward the police car, and lying on his stomach on the street is critical.

Almost all are ignoring it.

Watching the video, it is clear George Floyd is still resisting the police for the first four minutes.

He was dead when the ambulance arrived, according to the official EMS report.

There are many possibilities.

We need to see toxicology reports and the Autopsy, as well as hear the officers side of the story.

Yup. The people who do the usual "let's blame the dead guy" thing here need to stop and take a look at themselves in the mirror. The video shows a man being killed in cold blood by a police officer. That's what killed him - not a bad check or any other damn thing.

Was Floyd convicted of that?

And one had fired his service weapon twice, when most cops never fire theirs once. Anybody can file a complaint. That city is crime ridden.

I’m not defending or commenting on the specific incident here, but I’d like to see some of these clown on this website who calling for immediate execution and puffing their idiot chests out go be a police officer in thankless shithole city for 17 years, and see if they get a use-of-force complaint or if they have to draw their weapon. If this cop committed a crime and pays the price, Justice be done. But impugning his entire career is unnecessary.

Equivocating and casting about for potential technicalities does not change the fact that this man died because of that officer’s depraved indifference.

“We need to see toxicology reports and the Autopsy, as well as hear the officers side of the story.”

What is stopping the police officer involved from holding a press conference on the steps of city hall or at least voicing his side in a Zoom conference?
