VIDEO: Fulton County District Attorney Drills Huge Hole in Own Case

Fulton County (Atlanta) District Attorney Paul Howard drilled such a huge hole into his case by declaring a few weeks ago that a taser is a deadly weapon that the drilling even carried over into his interview with Wolf Blitzer. Yes, there is no escaping from the fact that the DA drilled a huge hole into his case that could easily undermine it. In fact, it is now almost certain that he will be called as a witness for the defense during the trial.

I also think that the chances of Atlanta Mayor Keisha Lance Bottoms being picked as Sleepy Joe's running mate also fell into that giant hole that the obviously political DA drilled.

I'm bothered a lot less by Gorsuch than Roberts. Gorsuch is a textualist, as was Scalia. That's a form of originalism, but it's not the same thing in every situation. And in a few cases, that distinction can matter a lot.

Best example is school segregation. An originalist might focus on the "original understanding" of the 14th Amendment, and say that it did not include outlawing segregated schools. They'd have come out the other way on Brown v. Board of Education, and affirmed Plessy v. Ferguson.

A textualist would focus on the language of the Amendment itself, and say "regardless of what they may have originally meant or intended at the time, the words 'equal protection of the laws' do not permit legal distinctions based on race.

I'm sure some may quibbble with the idea that originalists would be against Brown, and they may be right. I'm just illustrating the difference between focusing on the intent of a law, versus the words themselves.

I was worried about Gorsuch on the LGBT case for that reason. It's not that he's a closet leftist. He's just a hardline textualist. 95 times out of 100, that's good for us.

Taser is ONLY a deadly weapon in the hands of white police officers.

It is just a toy in the hands of a drunken felon.

Here’s Wikipedia’s 1st sentence in their article on Taser safety issues:

“Medical conditions or use of illegal drugs can significantly heighten such risk for subjects in an at-risk category.[1] In some cases however, death occurred after Taser use coupled with the use of force alone, such as positional asphyxiation, with no evidence of underlying medical condition and no use of drugs.”

But police are authorized use it as a non-lethal means of subduing, so my conclusion is that in rare cases it can be the primary cause of death.

You who have legal minds can answer. It appears that so many of these DA’s make decisions on their own without sound advice. Is there nobody in their offices who might tell them they’re building a case that won’t fly?
