A Statistically Meaningful Analysis of Mail-in Voting Patterns Proves Vote Fraud in Georgia and Pennsylvania

I took note over at PowerlineBlog today of this piece by John Hinderaker of a study published by Dr. John Lott using statistical analysis to examine comparative voting patterns in Georgia and Pennsylvania counties....

But the “30,000 ft view” of Dr. Lott’s conclusions — drawn from comparisons of patterns and behavior from precinct-level reporting of vote totals — is that, as a statistical matter, the EVIDENCE of vote fraud is inescapable.

Why have I emphasized “evidence”?

I did so because I want to distinguish the use of statistical data as evidence in a courtroom in an election challenge, and the use of such data as a general matter in other kinds of litigation.

In a typical election contest lawsuit brought by the losing candidate, that individual must come into Court with evidence showing the fraudulent process, and how many invalid votes were included as a result. To overturn the outcome of the election requires the challenger to prove that a specific number of invalid votes were included in the reported results, and removing those invalid votes from the vote totals would change the outcome of the contest.

As we saw played out in a number of lawsuits filed in the aftermath of the election, the Trump campaign was not able to marshall that kind of specific, ballot-level evidentiary record to invalidate a discrete set of cast ballots that would reverse the numerical result. They had significant anecdotal evidence of irregular and highly suspicious behavior, as well as some expert testimony regard insecure and vulnerable voting processes, but that expert testimony did not provide an answer to the question “Which specific ballots cast by which identified voters were invalid and why?”...

this is all very interesting. truly, it is. but a court of law is never, ever going to accept mathematical inference as evidence . . . of anything.

This is impossible, unless you want to give up the idea of a SECRET ballot.
The first thing cheaters want done is to get all the ballots - mail-in, in-person, absentee, provisional, whatever - into one pile, anonymous and untraceable. You can't tell if a ballot came in three days late, or from a precinct with 150% overvote, etc.

Is there a legal term for a case that is, by definition, impossible to prosecute?

I’ll give you that one; but even that took a major scotus case to establish the precedent.

We don’t have that precedent.

That is true but if the number of illegal voters exceeds the margin of victory the election can be invalidated.

You do not have to know who the illegal voters voted for.

The courts will not be considering evidence of fraud.
The only way the courts will get involved is to settle Constitutional disputes.

For example, if the state legislatures of any of the contested states move to rescind their illegitimate certifications, and their authority to do so is challenged - the courts will get involved in such a dispute.

In such a case, the courts will surely uphold the right of state legislatures to decertify or certify as they see fit, since this authority is clearly given to them in Article II, Section I, of the US Constitution.

The point of providing evidence of fraud is not to convince the courts of anything - it is not the courts place to settle whether there was fraud or not - only to settle whether or not Constitutional rights were violated. There may be some process cases taken up by the SC, such as the PA equal protection clause case - but even that case is likely to be deferred to the state legislature.

The purpose of showing evidence of fraud is to convince the state legislators of contested states that the certifications made by their respective Secretaries of State were in error and were not representative of a free and fair election.

The objections to electors and ensuing debates in the US House and Senate are really not going to determine the outcome - the way they will affect the outcome is indirect - this will be the first time many Americans get to see that there is a very strong case to be made - and much evidence and sworn testimony - that Joe Biden won this election by fraud.

The idea is to get the cat out of the bag.

As with the Russia collusion hoax,
As with the Kavanaugh hoax,
As with the Ukraine impeachment hoax,

Once the American people have heard both sides - the fake news narrative falls apart - Republicans realize they have no choice - and they fall in line.
