Federal judge deals blow to vaccine mandate for NYC teachers

"NEW YORK — New York City schools have been temporarily blocked from enforcing a vaccine mandate for its teachers and other workers by a federal appeals judge just days before it was to take effect.

The worker mandate for the the nation’s largest school system was set to go into effect Monday. But late Friday, a judge for the 2nd U.S. Circuit Court of Appeals granted a temporary injunction and referred the case to a three-judge panel an an expedited basis."

Trump judge Joseph F. Bianco of the Second Circuit Court of appeals was the one who issued the injunction blocking Smirking Chimp judge Brian M. Cogan’s initial blessing of the mandate.

No, did you read the article? A single judge (not a full panel) issued a temporary restraining order and then passed it on to the full panel for
Review on an expedited basis.

The case will now go to a three-judge federal panel for review, and it will likely be decided before the city’s vaccine mandate for schools takes effect at the beginning of next week.

We might get lucky.

Second Circuit: (1) Dubya judge, (2) Rapin Bill judges, (2) Odiousbama judges, (5) Trump judges, (1) BiteMe judge.

I didn't realize that The Senile Puddin Pop Puppet snuck one on to the Second.

So, it's 6-5 or 5-6 for the three-judge panel choice, depending on whether the Dubya judge is a squish. She's currently the chief judge of the Second [confirmed 91 - 0, but that was back in the old days].

In December, 2019, [Debra Ann] Livingston partially dissented from a federal appeals court ruling ordering that Donald Trump comply with a subpoena and turn over his tax returns to the U.S. House of Representatives.

She stated, "I cannot accept the majority's conclusions that 'this case does not concern separation of powers,' and that there is 'minimal at best' risk of distraction to this and future Presidents from legislative subpoenas of this sort."

Livingston said she would send the case back to a lower court and require the House committees to provide more details about the legislative purposes behind their requests before deciding whether the banks must comply.

I have had two cases before Judge Bianco when he was a district court judge. He is an extremely intelligent, very thorough judge. Or maybe I feel that way because he ruled in our favor both times... :-)

I understand he is also a devout Catholic and a deacon in his church.
